10.55.010 Definitions.

For purposes of this chapter:

“Fermented malt beverages” means any liquor or liquid capable of being used for beverage purposes, made by the alcoholic fermentation of an infusion in potable water of barley malt and hops, with or without: unmalted grains or decorticated and degerminated grains or sugar containing one-half of one percent or more of alcohol by volume.

“Intoxicating liquor” means all ardent, spirituous, or distilled liquors, liquids, or compounds, whether medicated, proprietary, patented, or not, and by whatever name called, containing one-half of one percent or more of alcohol by volume, which are fit for use for beverage purposes. 10.55.020 Possession prohibited.

No person shall open or consume intoxicating liquor or fermented malt beverages, nor shall any person have in his possession or control an open container of intoxicating liquor or fermented malt beverages while in a motor vehicle on public highway. (2008 code § 6.15(2))

10.55.030 Penalty.

Notwithstanding the provisions of Chapter 10.80 ETMC, the penalty for violation of this chapter shall be as provided for in Chapter 1.20 ETMC. (2008 code § 6.15(3))
