15.050 Zoning Districts.

(1) Names of Districts. The City of Manitowoc is hereby divided into zoning districts as follows:

(a) Conservancy Districts:

Conservancy P-1 – (Conservancy).

(b) Residential Districts:

Residential R-1 – (Residential-Agricultural).

Residential R-2 – (Single-Family).

Residential R-3 – (Single-Family).

Residential R-4 – (Single- and Two-Family).

Residential R-5 – (Low Density Multiple-Family).

Residential R-6 – (Multiple-Family).

Residential R-7 – (Central Residence).

(c) Business Districts:

Business B-1 – (Office-Residence).

Business B-2 – (Neighborhood Business).

Business B-3 – (General Business).

Business B-4 – (Central Business).

(d) Commercial Districts:

Commercial C-1 – (Commercial District).

(e) Industrial Districts:

Industrial I-1 – (Light Industry).

Industrial I-2 – (Heavy Industry).

(2) Establishment of Zones by Map. The boundaries of said zoning districts are shown upon the map on file in the City Planning office and made a part of the ordinance codified in this chapter, said map being designated as the “1987 Revised Zoning District Map,” and all notations, references, and other information shown thereon are a part of this chapter and have the same force and effect as if said zoning map and all such notations, references, and other information shown thereon were fully set forth or described herein.

(3) Changes in Boundaries. Changes in the boundaries of the districts shall be made by ordinance adopting an amended zone map, or part of said map, or unit or a part of said zoning map, which said amended maps, or parts of units of parts, when so adopted, shall become a part of this chapter.

(4) Uncertainty in Boundaries. Where uncertainty exists as to the boundaries of any districts shown on the maps accompanying and made part of this chapter, the following rules shall apply:

(a) Where such boundaries are indicated as approximately following street and alley lines or lot lines, such lines shall be construed to be such boundaries;

(b) Where the locations of the boundaries are shown to be other than streets, alley or lot lines, then such boundaries shall be construed to be 110 feet from and parallel with the street, unless shown to be otherwise by a distance in figures;

(c) Where a boundary line divides a lot under single ownership at the time of the passage of the ordinance codified in this chapter, the regulations for the less restrictive zone may extend to the entire lot, provided such extension does not exceed a distance of 40 feet beyond the boundary of such zone; and

(d) Where a public street or alley is officially vacated or abandoned, the area comprising such vacated street or alley shall acquire the classification of the property to which it reverts.

(5) Classification of Annexed Lands. All new territory annexed to the City shall automatically be classified as “R-1,” Residential-Agricultural District, unless designated otherwise by the Common Council, until definite boundaries and regulations for such territory are recommended by the City Plan Commission and adopted by the Common Council; provided, however, that the Common Council shall adopt, upon recommendation by the City Plan Commission, definite zone regulations for such districts within 120 days from the date of its annexation to the City.

(6) Annexation Petition Filing Fee. Whenever a petition for annexation is filed with the City Clerk, a filing fee, as established by resolution of the Common Council, shall accompany the petition. Such sum shall not be refunded whether or not the petition is accepted by the Mayor and Common Council.
