19.050 Repeal and Nonrepeal of Ordinances and Effect.

(1) Application and Effect of Revised Code. All ordinances or parts of ordinances of the City of Manitowoc, which are contained and incorporated in this consolidated code, published in book form, revising, consolidating and amending the general ordinances of the City of Manitowoc and entitled “The Municipal Code of the City of Manitowoc, Wisconsin, Revised 1950,” are hereby affirmed and reenacted without interruption in their operation and effect, and all ordinances or parts of ordinances enacted and adopted by the Common Council of the City of Manitowoc prior to June 19, 1950, are hereby repealed, except those ordinances and parts of ordinances mentioned in subsection (2) of this section.

(2) Ordinances Not Repealed. All ordinances or parts of ordinances relating to the following subjects are not repealed:

(a) The issuance of corporate bonds of the City of Manitowoc, of whatever name or description;

(b) The establishment of grades and curb or gutter lines in the public streets and alleys;

(c) The vacation and discontinuance of public streets and alleys;

(d) The fixing of salaries of public officials and employees;

(e) The granting of franchises to railroads or public utilities or to individuals, associations, companies or corporations;

(f) The lighting of streets;

(g) The construction of public works by the City of Manitowoc;

(h) The annexation of territory to the City of Manitowoc;

(i) The naming and changing of names of streets, alleys, playgrounds, public grounds and parks;

(j) The creation and establishment of districts wherein all wires, cables, etc., are required to be placed or located underground;

(k) The construction and repair of sidewalks on specified streets;

(l) Providing for the construction of sewers and water mains;

(m) The granting of pensions;

(n) All matters contained in and covered by charter ordinances (compiled, collected and contained in Chapter 2 MMC);

(o) All zoning ordinances, including the establishment of residential, commercial or industrial zones or districts (compiled, collected and contained in Chapter 15 MMC); provided, however, that any and all provisions in any of the ordinances mentioned in this subsection (2), conflicting with any of the provisions of this Municipal Code, shall be and they are hereby repealed, unless otherwise provided by law.

(3) Ordinances Repealed Not Reenacted. No ordinance or part of any ordinance, heretofore repealed, shall be considered as reordained or reenacted by virtue of the provisions of subsection (1) of this section.

(4) Effect of Repeal. When any ordinance repealing a former ordinance, or any part thereof, shall be itself repealed, such repeal shall not be construed to revive such former ordinance or such part thereof, unless it shall be expressly so provided.
