8.18.010 Intent.

The Board of Supervisors finds that certain late evening use of beaches located in the unincorporated area of the County have led to public disturbances, trespassing, destruction of private property and other public health and safety problems. The intent of this chapter is to regulate the evening use of certain beaches in the unincorporated area to prevent such misuse. [Ord. 5304 § 17, 2019; Ord. 5053 § 1, 2009; Ord. 3899 § 1, 1988].

8.18.020 Definitions.

(A)    “Live Oak Beach” means all of that area lying along the coast between the mean low water line and the privately-owned bluffs or highlands which rise above the sandy areas of the beach, and which is located within the Live Oak permit parking zone as defined by SCCC 9.44.030.

(B)    “Davenport Beach” means all of that area lying along the coast between the mean low water line and the privately-owned bluffs or highlands which rise above the sandy areas of the beach, and which is located on the following assessor parcel numbers:

(1)    Assessor parcel number 058-072-02.

(2)    Assessor parcel number 058-121-03.

(3)    Assessor parcel number 058-121-04.

(C)    “To camp” and “camping” means to establish or maintain at any time a temporary, including overnight, place of residence.

(D)    “Alcoholic beverage” means and includes alcoholic spirits, liquor, wine, beer and every liquid which is fit for beverage purposes and which contains more than one-half of one percent of alcohol by volume. [Ord. 5304 § 17, 2019; Ord. 5053 § 1, 2009; Ord. 4488 § 2, 1998; Ord. 3899 § 1, 1988].

8.18.030 Restrictions.

(A)    No person shall build or maintain a fire between the hours of 10:00 p.m. and 6:00 a.m. upon any Live Oak Beach or Davenport Beach. No person shall build or maintain a fire between the hours of 10:00 p.m. and 6:00 a.m. upon any privately-owned property abutting a Live Oak Beach or Davenport Beach without having first obtained written consent from the owner or person in lawful possession of the property.

(B)    No person shall camp on any Live Oak Beach or Davenport Beach. No person shall camp on privately-owned property abutting a Live Oak Beach or Davenport Beach without having first obtained written consent from the owner or person in lawful possession of the property.

(C)    No person shall willfully make or continue, or cause to be made or continued, any loud, unnecessary and unusual noise upon any Live Oak or Davenport Beach between the hours of 10:00 p.m. and 6:00 a.m. which disturbs the peace and quiet of any neighborhood or which causes discomfort or annoyance to any reasonable person of normal sensitivities residing in the area.

(D)    Any person drinking or consuming any alcoholic beverage or possessing any open alcoholic beverage container upon any Live Oak or Davenport Beach shall be in violation of SCCC 8.02.020 or 8.02.030.

(E)    The burning of combustibles containing nails, metal fasteners, glass, or other nonorganic matter upon any Live Oak or Davenport Beach is prohibited. [Ord. 5304 § 17, 2019; Ord. 5053 § 1, 2009; Ord. 4488 § 3, 1998; Ord. 4403 § 1, 1996; Ord. 3899 § 1, 1988].

8.18.040 Violation—Penalty.

Any person who violates any of the provisions contained in this chapter is guilty of a misdemeanor and punishable as provided in SCCC 1.12.030. [Ord. 5053 § 1, 2009; Ord. 3899 § 1, 1988].
