11.04.010 Basic rule and maximum limit.

In accordance with Alaska Statute 28.05.030 and Alaska Motor Vehicle Regulation 13 AAC 02.285 the following speed restrictions are established:

A.    A person may not drive a vehicle at a speed greater than is reasonable and prudent under the conditions and having regard to the actual and potential hazards existing at the time. Speed shall be controlled so as to avoid colliding with a person, vehicle or other conveyance operated in compliance with a legal requirement.

B.    Except when a special hazard exists that requires lower speed for compliance with subsection A, the limits specified in this section or established as authorized by this chapter or other law are the maximum lawful speeds, and a person may not drive a vehicle at a speed in excess of the maximum limit except as provided in this chapter. Maximum speed limits shall be as follows:

1.    Twenty-five miles per hour on a highway within a village or suburban area;

2.    Fifteen miles per hour on a village street;

3.    Twenty miles per hour within a school zone unless otherwise posted for a lower maximum speed limit;

4.    Fifty miles per hour on an unpaved state highway, other than a city street;

5.    Fifty-five miles per hour on paved state highway, other than a city street.

C.    A driver of a vehicle shall, consistent with subsection A, drive at an appropriate reduced speed when approaching and crossing an intersection, when approaching or going around a curve, when approaching a hillcrest, when traveling upon a narrow or winding roadway, or when a special hazard exists with respect to a pedestrian or other traffic, or by reason of weather or roadway condition.

D.    A person following a vehicle driving at less than the legal maximum speed and desiring to pass that vehicle may exceed the speed limit at only a speed and for only a distance necessary to complete the pass with a reasonable margin of safety. (Ord. 76-11 §1, 1976).

11.04.020 Establishing speed zones.

It is the responsibility of the borough manager to establish all speed zones provided for in Section 11.04.010. His decision shall be final and conclusive. (Ord. 76-11 §2, 1976).

11.04.030 Penalties.

Upon conviction a person who fails to comply with the requirements of this chapter is guilty of an infraction and is punishable by a fine not to exceed three hundred dollars. (Ord. 84-2 §1(part), 1984; Ord. 76-11 §3, 1976).
