20.08.010    Definitions generally.

For the purpose of this title, certain terms or words shall be defined as set out in this chapter. (Ord. 90-15 §11(part), 1991).

20.08.020    Access.

"Access" means the place, means or way by which pedestrians or vehicles shall have safe, adequate, and usable ingress and egress to a property use or parking space. (Ord. 90-15 §11(part), 1991).

20.08.030    Accessory structure or use.

"Accessory structure or use" means a structure or use incidental and subordinate to the main use of property. (Ord. 90-15 §11(part), 1991).

20.08.040    Amendment.

"Amendment" means a change in the wording, context, or substance of the zoning ordinance, or a change in the zone boundaries upon the zoning map. (Ord. 90-15 §11(part), 1991).

20.08.045    Bed and breakfast.

"Bed and breakfast" means an accommodation offered in a private home, consisting of a room for the night and breakfast the next morning for one inclusive price.  If the dwelling has six or more bedrooms available for rental to overnight guests it is a hotel and not a bed and breakfast.  (Ord. 2017-02 §2(part), 2017).

20.08.050    Building height.

"Building height" means the vertical distance from the average grade to the highest point of the coping of a flat roof or to the deck line of a mansard roof or to the average point of a pitched or high roof. (Ord. 90-15 §11(part), 1991).

20.08.060 Day care facility.

"Day care facility" means an institution, establishment, or place in which are commonly received at one time four or more children not of common parentage, for a period not to exceed twelve consecutive hours, for the purpose of being given board, care, or training apart from their parents or guardians for compensation or reward. (Ord. 90-15 §11(part), 1991).

20.08.070 Density (net).

"Density (net)" means the amount of dwellings per (net) acre, based on the total area of the parcel, including vacated rights-of-way, and excluding separate or noncontiguous lands, previously designated common open space, and excluding rights-of-way or easements. (Ord. 90-15 §11(part), 1991).

20.08.080 Dock.

"Dock" means a structure built over or floating upon the water, used as a launching place for marine transport or for recreational purposes. (Ord. 90-15 §11(part), 1991).

20.08.090 Dwelling, apartment or multifamily.

"Apartment or multifamily dwelling" means building designed and used for occupancy by three or more families, all living independently of each other, and having separate full kitchen facilities for each family. (Ord. 90-15 §11(part), 1991).

20.08.100 Dwelling, single-family.

"Single-family dwelling" means exclusively for the occupancy of one family, or less, and being entirely surrounded by open space on the same lot. (Ord. 90-15 §11(part), 1991).

20.08.110 Dwelling, two family (duplex).

"Two family dwelling (duplex)" means a building designed or used exclusively for the occupancy of two families living independently of each other and having separate housekeeping facilities for each family. (Ord. 90-15 §11(part), 1991).

20.08.120 Dwelling unit.

"Dwelling unit" means one or more rooms designed for occupancy by one family with separate toilet facilities and not having more than one cooking facility except facilities designed for camping purposes such as tents and recreation vehicles. (Ord. 90-15 §11(part), 1991).

20.08.130 Family.

"Family" means one person or two or more persons related by blood, marriage, legal adoption or guardianship, or a group of not more than five persons (excluding servants) all or part of whom are not related by blood, marriage, legal adoption, or guardianship living together as a single housekeeping unit in a dwelling unit. (Ord. 90-15 §11 (part), 1991).

20.08.140 Fence, sight obscuring.

"Sight obscuring fence" means a fence consisting of wood, metal, masonry, or similar materials, or an evergreen hedge or other evergreen planting arranged in such a way as to obscure vision at least eighty percent. (Ord. 90-15 §11(part), 1991).

20.08.150 Floor area.

"Floor area" means the sum of the net horizontal areas of each story of the principal building, measured from the exterior walls or from the center line of party walls, including the floor area of accessory uses and of accessory buildings and structures. (Ord. 90-15 §11(part), 1991).

20.08.160 Gasoline service station.

"Gasoline service station" means a retail place of business engaged primarily in the sale of motor fuels, but also supplying goods and services required in the operation and maintenance of automotive vehicles. (Ord. 90-15 §11(part), 1991).

20.08.170 Gross floor area.

"Gross floor area" means the floor area of all buildings on a site minus that area set aside for storage of equipment and/or supplies. (Ord. 90-15 §11(part), 1991).

20.08.180 Hazards.

"Hazards" means threats to life, property or the environment, such as landsliding, flooding, subsidence, erosion or fire. (Ord. 90-15 §11(part), 1991).

20.08.190 Home occupation.

"Home occupation" means a lawful occupation or profession carried on by a resident of a dwelling, and no more than one employee excluding members of his/her family. (Ord. 90-15 §11(part), 1991).

20.08.200 Hotel.

"Hotel" means a structure or portion of a structure which is occupied or intended and designed for occupancy by transients for dwelling, lodging, or sleeping purposes and includes any hotel, motel, inn, lodge, dormitory, or bed and breakfast. (Ord. 90-15 §11(part), 1991).

20.08.210 Junk or wrecking yard.

"Junk or wrecking yard" means any property where a person is engaged in breaking up, dismantling, sorting, distributing, buying or selling any scrap or waste material, including vehicles and equipment. (Ord. 90-15 §11(part), 1991).

20.08.220 Kennels.

"Kennels" means a lot or premises on which four or more adult dogs are kept, whether by owners of the dogs or by persons providing facilities and care for compensation. An adult dog is one that has reached the age of six months. (Ord. 90-15 §11(part), 1991).

20.08.230 Land coverage.

"Land coverage" means the portion of a lot or parcel of land which is covered with buildings, parking and maneuvering area, patios, decks, covered or paved storage area or other impervious surface. (Ord. 90-15 §11(part), 1991).

20.08.240 Land use.

"Land use" means any use of the land including, but not limited to, construction, subdivision, agriculture, recreation, public utilities placement, forest management, or natural uses. (Ord. 90-15 §11(part), 1991).

20.08.250 Loading space.

"Loading space" means an off-street space or berth on the same lot, or parcel, with a building or use, contiguous to a group of buildings or uses, for the temporary parking of a vehicle while loading or unloading persons, merchandise, or materials, and which space or berth abuts upon a street, alley, or other appropriate means of ingress or egress. (Ord. 90-15 §11(part), 1991).

20.08.260 Lot.

For purposes of this title, a lot is a parcel of land of at least sufficient size to meet minimum zoning requirements for use, coverage, and area and to provide such yards and other open spaces as are herein required. Such lot shall have frontage on an improved public street, or on an approved private street, and may consist of:

1.    A single lot of record;

2.    A portion of a lot of record;

3.    A combination of complete lots of record, of complete lots of record and portions of lots of record; and

4.    A parcel land described by metes and bounds. (Ord. 90-15 §11 (part), 1991).

20.08.270 Lot size.

"Lot size" means the total area of a lot measured in a horizontal plane within the lot boundary lines exclusive of public streets. (Ord. 90-15 §11(part), 1991).

20.08.280 Lot line, front.

"Front lot line" means for an interior lot, a line separating the lot from the street; and for a corner lot, a line separating either, but not both, frontage of the lot from the street. (Ord. 90-15 §11(part), 1991).

20.08.290 Lot line, rear.

"Rear lot line" means for an interior lot, a line separating one lot from another on the opposite side of the lot from the front lot line; for a corner lot either, but not both, interior lot line separating one lot from another; and for an irregular or triangular shaped lot, a straight line ten feet in length that is parallel to and at the maximum distance from the front lot line. 20.08.300 Lot line, side.

"Side lot line" means for interior lots, a line separating one lot from the abutting lot or lots fronting on the same street; for corner lots, a line other than the front lot line separating the lot from the street or a line separating the lot from the abutting lot along the same frontage. (Ord. 90-15 §11(part), 1991).

20.08.310 Lot width.

"Lot width" means the horizontal distance between side lot lines measured at the building line. (Ord. 90-15 §11(part), 1991).

20.08.320 Mobile home.

"Mobile home" means a transportable factory-built home, designed to be used as a residential dwelling. (Ord. 90-15 §11(part), 1991).

20.08.330 Nonconforming site.

"Nonconforming site" means a lot which does not conform to the regulations of the district in which it is located. (Ord. 90-15 §11(part), 1991).

20.08.340 Nonconforming structure or use.

"Nonconforming structure or use" means a lawful existing structure or use, at the time the ordinance codified in this title becomes effective, which does not conform to the requirements of the zone in which it is located. (Ord. 90-15 §11(part), 1991).

20.08.350 Nursing home.

"Nursing home" means a building, or portion thereof, wherein for compensation, living accommodations and care are provided for persons suffering from illness, other than contagious, which is not of sufficient severity to require hospitalization, or for persons requiring further institutional care after being discharged from a hospital. (Ord. 90-15 §11(part), 1991).

20.08.360 Open space.

"Open space" means the area devoted to lawns, setbacks, buffers; landscaped areas, natural areas, outdoor recreation areas, and similar types of uncovered, pervious surface, open areas maintained in plant cover, and excluding storage areas for materials, boats or vehicles. (Ord. 90-15 §11(part), 1991).

20.08.370 Parking.

"Parking" means privately or publicly owned property, other than streets, alleys or easements, on which parking spaces are defined, designated, or otherwise identified for use by tenants, employees, customers or owners of the property for which the parking area is required by this title. (Ord. 90-15 §11(part), 1991).

20.08.380 Parking space.

"Parking space" means an area permanently available for the parking of a full-size automobile, having dimensions of not less than ten feet by twenty feet. (Ord. 90-15 §11(part), 1991).

20.08.390 Permitted use.

"Permitted use" means any use authorized or permitted alone or in conjunction with another use in a specified zone district and subject to the limitations of the regulations of such zone district. (Ord. 90-15 §11(part), 1991).

20.08.400 Planning and zoning commission or commission.

"Planning and zoning commission" or "commission" means the planning and zoning commission of Bristol Bay Borough, Alaska. (Ord. 90-15 §11(part), 1991).

20.08.410 Plat.

"Plat" includes a final map, diagram, drawing, re-plat or other writing containing all the descriptions, locations, specifications, dedications, provisions and information concerning a subdivision or major partition. (Ord. 90-15 §11(part), 1991).

20.08.420 Policy.

"Policy" means a definitive statement or requirement of the borough’s coastal management plan or zoning ordinance. Generally qualitative in nature. (Ord. 90-15 §11(part), 1991).

20.08.425 Processing plant.

"Processing plant" means a facility of one or more structures operated for the purpose of processing marine life or other natural resources into products. (Ord. 95-1 §1, 1995).

20.08.430 Right-of-way (public).

"Right-of-way (public)" means all public streets and property dedicated to public use for streets together with public property reserved for public walkways, sidewalks, bikeways or equestrian trails. (Ord. 90-15 §11(part), 1991).

20.08.440 Schools--Primary, elementary, junior high or high.

"Schools--primary, elementary, junior high or high" includes public, private, or parochial but not nursery school, kindergarten, or day nursery, except when operated in conjunction with a school. (Ord. 90-15 §11(part), 1991).

20.08.450 Setback.

"Setback" means the distance that buildings or uses Must be removed from their lot lines or right-of-way lines. (Ord. 90-15 §11(part), 1991).

20.08.460 Standards.

"Standards" means specific requirements of the development ordinance regulating land use, generally quantitative in nature. (Ord. 90-15 §11(part), 1991).

20.08.470 Street.

"Street" means an officially approved public thoroughfare or right-of-way dedicated, deeded or condemned, which has been officially approved by the commission and accepted by the assembly, pursuant to Chapter 2.90 of the Bristol Bay Borough Code, for use as such, other than an alley, which affords the principal means of access to abutting property, including avenue, place, way, drive, boulevard, highway, road, and any other thoroughfare, except as excluded in the ordinance. The word "street" shall include all arterial highways, freeways, traffic collector streets, local streets, and lanes. (Ord. 90-15 §11(part), 1991).

20.08.480 Structure.

"Structure" means something constructed or built having a fixed base on, or fixed connection to, the ground or fences, retaining walls less than three feet in height, and similar improvements of a minor character. (Ord. 90-15 §11(part), 1991).

20.08.490 Subdivision.

"Subdivision" means either an act of subdividing land or an area or a tract of subdivided land. Subdivision in this context means to divide an area or tract of land within a calendar year when such area or tract of land exists as a unit or contiguous units of land under single ownership at the beginning of such year. (Ord. 90-15 §11(part), 1991).

20.08.500 Use.

Use" means the purpose for which land or a structure is designed, arranged, or intended, or for which it is occupied or maintained. (Ord. 90-15 §11(part), 1991).

20.08.510 Veterinary clinic.

"Veterinary clinic" means the office of a licensed veterinarian together with rooms for operating on and temporarily holding animals. (Ord. 90-15 §11(part), 1991).
