20.12.010 Zoning categories.

The zoning categories in the Bristol Bay Borough are hereby established as follows:

Residential

To provide a suitable environment for single-family and low density dwellings.

Multifamily Residential

M

To encourage medium density multifamily development close to public services and employment.

General Commercial

C

To locate larger scale, vehicle oriented commercial activities in areas where highway access is available and where conflict with residential uses is minimized.

Industrial

I

To establish locations that provide the essential needs for industrial development: access, convenience of goods transfer, and buffering to protect adjacent zone categories.

Unrestricted

U

Any legal purpose.

20.12.020 Maps.

The boundaries of the zoning categories are shown on the official zoning maps of the Borough, which are incorporated in the ordinance codified in this title as Figures 1 through 3. The official maps, designated "Official Bristol Bay Borough Zoning Map," shall be filed with the borough clerk, and shall be displayed in the planning department offices. The official map series bears the same date as said signature by the presiding officer of the assembly, a part of this existence of purported copies of the zoning maps, regardless of the existence of purported copies of the zoning maps which may from time to time be made, shall be the final authority as to the current zoning status of lands, water areas, buildings, and other structures in the borough. 20.12.030 Rules of construction.

If any zoning district boundaries shown on Figures 1 through 3 of the ordinance codified in this title or the official zoning maps require interpretation with respect to specific properties, the following rules shall apply:

A.    Where zone boundaries are indicated as approximately following the centerline of streets, alleys or highways, the actual centerline shall be construed to be the boundary;

B.    Where zone boundaries are indicated as running approximately parallel to the centerline of the street, the boundary line shall be construed to be parallel to the centerline of the street;

C.    Where zone boundaries are indicated on such map as approximately following lot or tract lines, the actual lot or tract line shall be construed to be the boundary of such zone;

D.    Where a zone boundary on such map divides a tract in unsubdivided property, the location of such zone boundary, unless the same as indicated by dimensions thereon, shall be determined by use of the scale appearing on such zone map;

E.    Zone boundaries indicated as following shorelines shall be construed to follow such shorelines, and in the event of change in the shoreline, shall be construed to be the boundary of such zone;

F.    Where a public street or alley is officially vacated or abandoned, the regulations applicable to the abutting properties to which the vacated portion shall revert shall apply to such vacated or abandoned street or alley; and

G.    In case uncertainty exists which cannot be determined by application of the foregoing rules, the planning and zoning commission shall recommend, and the borough assembly shall determine, the location of such zone boundaries. (Ord. 90-15 §2.3, 1991).
