2.72.010 Established.

There is established the South Tahoe Public Utility District contract commission of Alpine County, hereinafter referred to as the “STPUD commission,” created as an advisory commission to the board of supervisors of the county to consider applications for repeal, modification, or amendment of the agreement between the South Tahoe Public Utility District and the county and the county water agency, as amended. 2.72.020 Membership.

The STPUD commission will be comprised of seven members, appointed by the board of supervisors. The appointees shall consist of two members of the board of supervisors, two selected county department heads, two public members and one member representing agriculture within the county. All members shall serve at the pleasure of the board of supervisors. The commission shall choose from among its members a chairman and vice-chairman. The county clerk shall serve as ex-officio clerk of the commission and the county counsel shall serve as its legal advisor. (Ord. 639 § 1 (part), 2002: Ord. 441 § 2, 1984)

2.72.030 Terms of office and compensation.

The STPUD commission shall meet upon notification that a proposal has been referred to it by the board of supervisors for its consideration, findings and recommendations. However, the STPUD commission shall meet not less than once a year to review the current agreement and any information pertinent thereto which is brought to the commission’s attention. The county clerk shall call the annual meeting as needed. All meetings shall be noticed and held pursuant to state law and conducted under such rules of procedures as the commission may from time to time establish. 2.72.040 Public hearings.

In connection with the consideration of any referral, the STPUD commission shall hold a minimum of one public hearing, notice of which shall be posted at the Courthouse and at least two other public places in the county. (Ord. 441 § 4, 1984)

2.72.050 Reports of recommendations.

The STPUD commission shall forward its findings and recommendations on each referral to the board of supervisors for its consideration. (Ord. 441 § 5, 1984)

2.72.060 Referral requirement.

In no case shall any application or proposal for repeal, modification, or amendment of the agreement between the South Tahoe Public Utility District and the county and the county water agency be acted upon by the board of supervisors prior to referral to the STPUD commission and in no event shall action be taken by the board of supervisors on any application or proposal until the elapse of at least sixty days from the initiation of the application or proposal.
