8.28.010 Purpose of provisions.

The state of California has passed Health and Safety Code Section 25280, et seq., relating to the storage of hazardous substances in underground tanks. These laws contemplate the individual counties in the state implementing and enforcing the provisions of these laws. Alpine County hereby adopts the ordinance set out in this chapter with the purpose of enforcing these laws. (Ord. 469 § 1, 1987)

8.28.020 Statutory provisions adopted.

The county hereby adopts by reference the requirements of Chapter 6.7 of Division 20 of the Health and Safety Code, Sections 25280 through 25299.6, inclusive, and the regulations pursuant thereto, as adopted by the State Water Resources Control Board for the underground storage of hazardous substances.

The county adopts by reference the requirements of Chapter 6.75 of Division 20 of the California Health and Safety Code, and the regulations pursuant thereto, as adopted by the California State Water Resources Control Board for the underground storage of hazardous substances. 8.28.030 Administration and enforcement authority.

The county designates the county health department as the implementing agency responsible for administration and enforcement of the provisions of the state law and regulations pursuant thereto adopted by the State Water Resources Control Board relating to underground storage of hazardous substances. 8.28.040 Permit fees and state surcharge.

Pursuant to the provisions of Chapter 6.7 of Division 20 of the Health and Safety Code and the regulations promulgated thereto, the board of supervisors shall from time to time set permit fees relating to the construction, maintaining and/or abandoning of underground storage facilities for hazardous substances. Commencing July 1, 1987, the following permit fees shall be effective:

A. Annual Permit to Operate.

1. Every person applying for an annual permit to operate an underground storage facility for hazardous substances shall submit fees for a permit to operate in accordance with the provisions of this section.

2. Fees for a permit to operate shall be determined as follows: Every facility (or person) owning/operating an underground storage tank for hazardous substances shall submit a fee of thirty-five dollars per facility per year. In addition to the facility fee, there will be a fee of thirty dollars per tank per year for each tank located at that facility.

3. Such billing will be issued on the form attached to the ordinance codified in this chapter and made a part hereof as Exhibit A, on file with Ordinance 469 in the office of the county clerk.

B. Installation/Abandonment Fees. Every person determining to install or permanently close an underground storage facility for hazardous substances shall submit fees in accordance with this section. Fees for installation or for permanent abandonment shall be fifteen dollars per underground tank.

C. State Surcharge. The county shall collect the annual surcharge for each underground storage tank, which is imposed and determined by the state of California. This fee is in addition to any other fees collected. (Ord. 469 § 4, 1987)
