18.88.010 Procedures applicable.

The following appeal procedures set forth in this chapter shall be applicable to all entitlements contained in this title. (Ord. 453 § 28.00, 1985)

18.88.020 Appeal of decision by planning director, other county official or design review committee.

If the applicant or any aggrieved party is dissatisfied with any decision of the county planner, other county official or the design review committee, relative to any entitlement pursuant to this title, he, she or they may within ten days of the date of the decision, appeal to the planning commission. Such appeal shall set forth in writing the reasons for the appeal. It shall include fees as set forth in the county Fee Ordinance and it shall be submitted to the planning department. The planning department shall schedule the matter for hearing by the commission within forty-five days and shall notify all adjacent property owners in person or by mail at least ten days prior to such hearing. The commission, within ninety days of receipt of the appeal from the planning department, shall approve, conditionally approve or deny the application. (Ord. 453 § 28.01, 1985)

18.88.030 Appeal of decision of planning commission.

If the applicant or aggrieved party is dissatisfied with the decision of the commission, he/she may within ten calendar days, Sunday or holidays not to be counted as the last day, appeal to the board. Such appeal shall set forth in writing the reasons for the appeal and shall be submitted to the clerk of the board. A copy of such appeal shall be sent to the planning commission. Said clerk shall schedule the matter for public hearing before the board within forty-five days and publish notice of such hearing in a local newspaper of general circulation at least ten days before the hearing. Within thirty days of such hearing, the board shall approve, conditionally approve or deny the application. If there is no newspaper of general circulation, the notice shall be posted in at least three public places within the county. (Ord. 583 § 1, 1995: Ord. 453 § 28.02, 1985)

18.88.040 Special clarifications or interpretations.

The planning commission shall consider written requests for the interpretation of the provisions of this title. Requests for interpretation shall be governed by the procedure, time frame and fees required for appeals outlined in Section 18.88.020 except that the county planner may waive the requirement for notification of adjacent property owners and shall in such instances reduce the fee required for appeals by one-half.
