Chapter 4.12
PRODUCTS CONTAINING PSEUDOEPHEDRINE

Sections:

4.12.01    Purpose and intent.

4.12.02    Display of products containing pseudoephedrine.

4.12.01 Purpose and intent.

A.    The City Council finds that the use of methamphetamine is a national health crisis that affects the health, safety and welfare of the citizens of the City of Clovis and the County of Fresno. The City Council further finds that the local production of methamphetamine, a key component of which is pseudoephedrine, is of staggering proportions. While State law limits the sale of products containing pseudoephedrine, a common ingredient in cold medicine, to three (3) packages at one time, the City has observed teams of people buying three (3) packs of cold medicine and collecting them outside the store.

B.    This chapter is intended to place limits on the display of medications containing pseudoephedrine in an attempt to limit a methamphetamine manufacturer’s ability to obtain pseudoephedrine for the illegal production of methamphetamine. Fresno County has adopted a similar ordinance for unincorporated portions of the County. The adoption of this chapter together with the Fresno County ordinance and any similar ordinances adopted by other Fresno County cities will help address the local methamphetamine problem.
