4.13.01 City of Fresno driver’s permit and taxicab vehicle permit.

No person shall operate or cause to be operated any taxicab within the City of Clovis without a valid, unexpired and unrevoked taxicab driver’s permit and taxicab vehicle permit issued by the City of Fresno pursuant to Article 9 of Chapter 9 of the Fresno Municipal Code, as that article may be amended or supplemented from time to time, or as that Article may be replaced by a new ordinance governing the regulation of taxicabs. 4.13.02 City of Clovis business license.

No person shall operate or cause to be operated any taxicab within the City of Clovis without a valid, unexpired and unrevoked business license issued by the City of Clovis. Anyone who operates or causes to be operated any taxicab in the City must apply for a business license through the City’s Finance Department and pay applicable license fees. A copy of a valid Clovis business license shall be kept with a taxicab operator at all times while doing business in the City and shall be made available to law enforcement officers and any City code enforcement official upon request. 4.13.03 Exception.

No business license, taxicab driver’s permit, or taxicab vehicle permit shall be required for a taxicab which is lawfully transporting a passenger from a point outside this City to a destination within this City, or which is en route from a point outside this City to a destination outside this City; provided, that no driver of a taxicab without such business license, taxicab driver’s permit, and taxicab vehicle permit shall solicit or accept a passenger or passengers from within this City for transportation to any destination whatsoever. 4.13.04 Operational and facility standards.

The City of Fresno operational and facility standards, including any amendments thereto, shall be deemed applicable in the City. A violation of those operational and facility standards shall be deemed a violation of the Clovis Municipal Code. (§ 2, Ord. 10-01, eff. February 10, 2010)

4.13.05 Supplemental rules and regulations: Policies and procedures.

The City Council may adopt supplemental rules and regulations governing the operation of taxicabs in the City. A violation of those supplemental rules and regulations shall be deemed a violation of this chapter.

In addition to the foregoing, the City Manager may adopt policies and procedures for implementing this chapter. (§ 2, Ord. 10-01, eff. February 10, 2010)

4.13.06 Conflicts.

If any conflicts between this chapter and any other City, State or Federal law should arise, the most restrictive code providing the highest level of safety as determined by the City Manager shall prevail. (§ 2, Ord. 10-01, eff. February 10, 2010)

4.13.07 Violations.

Any person violating any of the provisions of this chapter, or supplemental rules and regulations adopted hereto, shall be subject to the penalty provisions of Chapter 2 of title 1.

The act or omission of any permittee’s and/or owner’s officer, agent, employee or independent contractor, or of any driver whose services are engaged by any of the above, is for all purposes the act or omission of the respective permittee and/or owner operating the transportation services regulated by this chapter. 4.13.08 Service fee.

The City may levy service fees in an amount sufficient to pay for the costs of carrying out this chapter. (§ 2, Ord. 10-01, eff. February 10, 2010)
