10.30.010 Parking prohibited – No stopping, standing or parking.

No person shall park any vehicle or cause, allow, permit, or suffer any vehicle registered in that person’s name or controlled by that person to be parked, either attended or unattended, adjacent to any curb marked or posted to prohibit stopping, standing, or parking, except that a bus may stop adjacent to any curb marked or posted to prohibit stopping, standing, or parking if the curb is marked or posted as a bus loading zone. 10.30.020 Yellow curbs.

No person shall park any vehicle or cause, allow, permit or suffer any vehicle registered in his name or controlled by him to be parked adjacent to a curb painted yellow, except for the purpose of loading or unloading freight, and then only for the time actually necessary for the same, but not to exceed in any event a maximum period of thirty consecutive minutes. 10.30.030 White curbs.

No person shall park any vehicle or cause, allow, permit or suffer any vehicle registered in his name or controlled by him to be parked adjacent to a curb painted white except for the purpose of loading or unloading passengers, and then only for the time actually necessary for the same, but not to exceed in any event five consecutive minutes. (Ord. 785 § 1(part), 2006).

10.30.040 Unmetered overtime parking on streets.

No person shall park any vehicle or cause, allow, permit or suffer any vehicle registered in that person’s name or controlled by that person to be parked on a block in excess of the maximum length of time indicated on signs posted on the block. (Ord. 785 § 1(part), 2006).

10.30.050 Blue curbs.

No person shall park any vehicle or cause, allow, permit or suffer any vehicle registered in his name or controlled by him to be parked adjacent to a curb painted blue at any time unless said vehicle displays either one of the distinguishing license plates issued to disabled persons pursuant to Section 22511.5 of the California Vehicle Code or to disabled veterans, as specified in Section 9105 of the California Vehicle Code. 10.30.060 Parking wholly in designated space.

No person shall park any vehicle, or cause, allow, permit or suffer any vehicle registered in his name or operated or controlled by him to be parked in such a position that it will not be entirely within a parking space, where such is designated by distinctive colored pavement or by lines or markings painted upon the curb or street adjacent thereto, or within a public off-street parking facility. 10.30.070 Parking – Setting brakes, etc.

No person shall cause, allow, permit or suffer any vehicle registered in his name or operated or controlled by him to be parked upon any street or any public or private off-street parking facility with a perceptible grade without setting the brakes thereon and blocking the wheels of said vehicle by turning them against the curb or by other means. (Ord. 785 § 1(part), 2006).

10.30.080 Parking in alleys.

No person shall cause, allow, permit or suffer any vehicle registered in his name or operated or controlled by him to be parked in any alley for any purpose other than loading or unloading freight from adjacent property. (Ord. 785 § 1(part), 2006).

10.30.090 Parking over seventy-two hours – Removal.

No person shall park or cause, allow, permit or suffer any inoperable vehicle or any vehicle registered in his or her name or operated or controlled by him or her to be parked on any street or alley for a period of seventy-two consecutive hours or more. Any such vehicle so parked may be removed by the Cotati police department in accordance with Sections 22651 and 22669 of the Vehicle Code of the state of California.

For purposes of this section, a vehicle shall be deemed to be parked on a street or alley for a period of seventy-two consecutive hours when it has not moved at least one mile during the seventy-two hour period. An inoperable vehicle is a vehicle that cannot be moved under its own power or a vehicle which cannot operate legally and safely on the highways of the state. Pushing or moving a vehicle a short distance or attempting to rub away the tire marking will not be considered compliance with this section. The mileage reflected on the odometer of the vehicle shall be presumed to be an accurate indication of the distance that the vehicle has or has not been moved. Obstruction of the odometer of the vehicle will result in a presumption that vehicle has not been moved. (Ord. 785 § 1(part), 2006).

10.30.100 Parking on posted private property.

No person shall park any vehicle on private property without the permission of the property owner or person in lawful possession of the property under any of the following circumstances described by Vehicle Code Section 22658:

A. There is displayed, in plain view at all entrances to the property, a sign not less than seventeen by twenty-two inches in size, with lettering not less than one inch in height, prohibiting public parking and indicating that vehicles will be removed at the owner’s expense, and containing the telephone number of the city police department. The sign may also indicate that a citation may also be issued for the violation.

B. The vehicle has been issued a notice of parking violation, and ninety-six hours have elapsed since the issuance of that notice.

C. The vehicle is on private property and lacks an engine, transmission, wheels, tires, doors, windshield, or any other major part or equipment necessary to operate safely on the highways, the owner or person in lawful possession of the private property has notified the city police department, and twenty-four hours have elapsed since that notification.

D. The lot or parcel upon which the vehicle is parked is improved with a single-family dwelling.

Any vehicle parked in violation of this section may be removed in accordance with the revisions of Vehicle Code Section 22658. (Ord. 785 § 1(part), 2006).

10.30.110 Parking vehicles for hire – Permit required.

No person shall park any vehicles used or intended to be used in the transportation of property for hire upon any street while waiting patronage for such vehicle without first obtaining a permit pursuant to Chapter 5.12 (Vehicles for Hire) which designates the specific location that such vehicle may stand. Such permit may be revoked in accordance with the provisions of Chapter 5.12. (Ord. 785 § 1(part), 2006).

10.30.120 Repairing or greasing vehicles on public streets.

No person shall construct or cause to be constructed, repair or cause to be repaired, grease or cause to be greased, dismantle or cause to be dismantled any vehicle or any part thereof upon any public street in this city. Temporary emergency repairs may be made upon a public street. (Ord. 785 § 1(part), 2006).

10.30.130 Washing or polishing vehicles on public streets.

No person shall wash or cause to be washed, polish or cause to be polished any vehicle or any part thereof upon any public street in this city, when a charge is made for such service. (Ord. 785 § 1(part), 2006).

10.30.140 Parking not to obstruct sight distance.

No person shall park or leave standing a vehicle which is seven feet or more in height, including any load thereon, within one hundred feet of any intersection, as measured from intersecting curb lines or approximate edge lines of pavement. (Ord. 785 § 1(part), 2006).

10.30.150 Temporary parking restrictions.

Whenever the chief of police determines that traffic congestion may result from public or private events or activities, the chief (or designee) may place signs restricting or prohibiting the operation, parking, or standing of vehicles on such streets and alleys. (Ord. 785 § 1(part), 2006).

10.30.160 Barriers.

When any barrier or sign has been placed, giving warning not to drive over or across newly laid pavement or freshly painted marking in any street, or stating that the street or portion thereof is closed, or controlling the entrance to, the exit from, or the parking within, or on, any public off-street facility or place, no person shall ride or drive any vehicle contrary thereto. 10.30.170 Parking of trailers prohibited.

No person who owns or has possession, custody or control of any trailer shall park such trailer upon any street, alley, public way or public place for more than six hours, unless such trailer, at all such times it is so parked, is attached to a motor vehicle capable of providing the motive power for moving the trailer upon the highway, street, alley, public way or public place.

As used in this section, a “trailer” is a vehicle designed for carrying persons or property, such as boats or horses, on its own structure and for being drawn by a motor vehicle and so constructed that no part of its weight rests upon any other vehicle. A “trailer” as used in this section shall not include any mobile device owned or operated by a public agency (such as speed radar trailers or trailers carrying generators, etc.) which is parked or left standing for the purpose of being utilized in the performance of a governmental function. 10.30.180 Removal of vehicles in violation of this chapter.

Unless otherwise provided by this chapter or otherwise provided by law, any vehicle parked or left standing in violation of any of the provisions in this chapter may be removed pursuant to Vehicle Code Section 22651(n). No vehicle may be removed under this section unless signs are posted giving notice of removal. (Ord. 785 § 1(part), 2006).
