EMERGENCY RESPONSE—RECOVERING OF COSTS

3.20.010 Incorporation by reference—Government Code sections.

Sections 53150 to 53158, inclusive, of the Government Code are incorporated by reference, which permits the city to recover the costs of emergency response. (Ord. 697 § 1 (part), 1987)

3.20.015 Intent of city.

The city declares its intent to collect the cost of emergency response by its police department from those persons in violation of California Vehicle Code Sections 23152 and 23155 (driving under the influence of alcohol or drugs or both). (Ord. 697 § 1 (part), 1987)

3.20.020 Emergency response costs—Police department.

The city council finds that the police department has made a study of the cost of emergency response for its various officers regarding the Vehicle Code violations and report making and has determined said costs to be:

A.    Primary Costs. From the time of initial response to the emergency until the suspect is completely booked (presuming the suspect is immediately available for booking), the charge will be one dollar and seventy-three cents per minute.

B.    Secondary Costs. The actual report costs will be seven dollars and one cent per page. (Ord. 697 § 1 (part), 1987)

3.20.021 Emergency response costs—Fire department.

The city council finds that the fire department has made a study of the cost of emergency response for its various officers and firemen regarding the Vehicle Code violations and report making and has determined said costs to be:

A.    Primary Costs. From the time of initial response to the emergency until the suspect is completely booked (presuming the suspect is immediately available for booking), the charge will be eighty-one cents per minute.

1.    Vehicle Maintenance Costs.

a.    Fire apparatus responding:

i.    E-1, one hundred dollars for the first hour, and fifty dollars for each additional hour;

ii.    E-2 and E-3, fifty dollars per hour.

b.    All damaged or broken departmental equipment will be charged at their replacement costs.

2.    Off-Duty Personnel. From the time of the initial response to the end of the emergency. These costs will include the hourly rate for on-duty personnel, and overtime charges for off-duty responding personnel.

Overtime charges (min. 2 hour call-out):

a.    Captain, sixteen dollars and forty-nine cents per hour;

b.    Firefighter II, fourteen dollars and twenty-one cents per hour;

c.    Firefighter I, twelve dollars and eighty-six cents per hour.

B.    Secondary Costs. The actual report costs will be two dollars and seventy-four cents per page. (Ord. 698 § 1, 1987)

3.20.030 Amendment of charges.

The charges set out in Sections 3.20.020 and 3.20.021 may be amended by resolution. (Ord. 697 § 1 (part), 1987)

3.20.040 Finance department—Collector of fees.

The finance department shall be the collector agent for the city and is authorized to take all action necessary to collect same and shall account for the receipts and disbursements thereof. (Ord. 697 § 1 (part), 1987)
