7.08.010 Definitions.

For the purpose of Chapters 7.08, 7.12, 7.16 and 7.20, certain words and terms are defined as follows:

A.    “Authorized containers” means containers for nonputrescible rubbish, yard waste or rubble only; sturdy, leakproof, wooden, metal, rubber or plastic containers of ten to thirty gallons capacity and with a loaded weight not to exceed sixty-five pounds. Oil or other nontapered sided barrels or drums used without a rubber or plastic liner or containers larger than approximately thirty gallons or containers with sharp edges are not acceptable and will not be emptied. Plastic or fiber bags are also authorized as yard waste containers provided they are watertight and of sufficient strength to contain the contents therein. Cardboard boxes are acceptable only for dry materials, when in sturdy condition and during dry weather. “Authorized containers” shall not be defined to include “standard containers” defined elsewhere in this section.

B.    “Bundle” means a package containing yard waste only, not exceeding four feet in its longest dimension, nor sixty-five pounds in weight, securely tied with cord or rope of sufficient strength to permit lifting and carrying of the full weight thereof without spillage or leakage and placed for collection immediately adjacent to a standard container. It includes but is not limited to the following:

1.    Tree limbs;

2.    Brush and prunings;

3.    Christmas trees in four-foot lengths, not tied. (Brush, prunings and tree limbs must be in bundles rather than containers).

C.    “Garbage” means refuse accumulations of animal, fruit or vegetable matter that attend the storage, sale, preparation and use of meat, fish, fowl, fruits or vegetables; tin cans or other containers originally used for foodstuffs; and other discarded or abandoned putrescible organic materials.

D.    “Refuse” means garbage, rubbish or both.

E.    “Refuse supervisor” means the public works manager of the city, or such person designated by him to supervise the refuse collection and disposal service for the city.

F.    “Rubbish” means all organic or inorganic materials, not defined herein as garbage or rubble, which are rejected, abandoned or discarded by the owners or producers thereof as offensive or useless or no longer desired by such owners or producers. These materials include, but are not limited to, pasteboard boxes, paper, rags, used clothing, discarded or abandoned bedding, discarded or abandoned mattresses, discarded or abandoned carpets, discarded or abandoned oil cloth and linoleum, sweeping or cleanings from buildings; bottles, tin cans or containers, broken crockery and glassware; old metals, wire, packing or wrapping materials and cold ashes; rope, twine, jute, bagging or burlap.

G.    “Rubble” means rocks, concrete, bricks and similar solid material, plaster, dirt and similar abandoned or discarded inorganic, noncombustible, nonputrescible materials; building construction or demolition waste materials; sod.

H.    “Standard containers” means plastic wheeled containers of approximately one hundred ten gallons in capacity, more or less, which are provided by the city and handled by automated equipment used by the city’s contractor. These containers are provided for the storage of garbage, refuse, rubbish and other putrescible wastes until such time as they are collected by the city’s contractor and properly disposed of in an authorized landfill facility.

I.    “Unauthorized materials” means materials that shall not be disposed of through collection services provided by the city. These include materials that are deemed to be hazardous as defined by the U.S. E.P.A., the State of California Department of Health Services and the Solid Waste Supervisor; and materials deemed to be inappropriate for landfill storage. These materials shall include but are not limited to hazardous chemicals, waste oil, petroleum products, and waste tires.

J.    “Yard waste,” also known as “greenshed,” means tree limbs, brush trimming and prunings, discarded Christmas trees, lawn trimmings, vines, stalks and stems from gardens. (Ord. 91-2 (part), 1991: Ord. 486 § 1, 1971)

7.08.020 Penalty for violation.

The penalty for violations of Chapters 7.08, 7.12, 7.16 and 7.20 shall be as prescribed in Section 1.16.010. (Ord. 91-2 (part), 1991: Ord. 505 § 2 (part), 1973: Ord. 486 § 15, 1971)
