9.40.010 Obstructing street or sidewalk—Person.

No person shall loiter or stand or sit in or upon any public highway, street, alley, sidewalk or crosswalk in this city so as to in any manner hinder or obstruct the free passage therein or thereon of persons or vehicles passing along the same, or so as, in any manner, to annoy or molest persons passing along the same. (Prior code § 7011)

9.40.020 Obstructing public entrances.

No person shall loiter or stand or sit in or at the entrance to any church, hall, theater or other place of public assemblage in this city, so as to in any manner obstruct such entrance. (Prior code § 7012)

9.40.030 Parades.

It is unlawful for any person, firm, copartnership, corporation or association to hold, manage, conduct, carry on, or to cause or permit to be held, managed, conducted or carried on, any parade, march or procession of any kind (other than a funeral procession) or to make any display of, or to use, beat or operate any wind instrument, stringed instrument or musical instrument in or upon any public highway, public park or public place in this city without having first obtained from the council a written permit so to do. 9.40.040 Exceptions to provisions.

There are excepted from the provisions of Sections 9.40.030 and 9.40.060, parades, marches or processions conducted with the approval and under the control of any public school or the Chamber of Commerce of the city; provided that written notice of intention to conduct the same and the route to be traversed shall be filed with the chief of police at least forty-eight hours before the same is to be conducted. 9.40.050 Speeches in public places.

No person shall hold, conduct or address any assemblage, meeting or gathering of persons, or make or deliver any public speech, lecture or discourse, or conduct or take part in any public debate or discussion, unless under and by authority of a written permit from the council, in or upon any public highway, street, alley, sidewalk or crosswalk in this city. (Prior code § 7014)

9.40.060 Permit to parade, speak—ApplicationRequired.

Every person, firm, corporation, copartnership or association desiring to carry on, engage in or do any acts set forth or regulated by or in Sections 9.40.030 and 9.40.050, shall first make a written application to and secure from the city council a written permit therefor, and which application shall be signed by the applicant if an individual, or by the managing agent thereof if it be a firm, corporation or association. 9.40.070 Permit to parade, speak—ApplicationContents.

A.    Said application shall be upon forms prescribed by the council and shall specify the time and place wherein and for which the permit is desired.

B.    The application shall be accompanied by a certificate signed by at least three reputable residents of the city certifying as to the character and reputation of the applicant or his managing agent. (Prior code §§ 7015.1, 7015.2)

9.40.080 Permit to parade, speak—ApplicationHearing.

Upon the hearing of an application, the council shall consider any facts or evidence bearing on the place where the assembly, speech, public debate or other proposed public act or action is to be held and its relation to the public peace, health and safety of the community, and may grant or deny the application in whole or in part and under such restrictions as the council deems necessary therefor. 9.40.090 Permit to parade, speak—Effect and scope.

All permits issued pursuant to this chapter shall be nontransferable and nonassignable, and shall be but for one act or action and for but one place or course. (Prior code § 7017)

9.40.100 Permit to parade, speak—Revocation.

It shall be the duty of the council, and it shall have the right, to deny any application and to revoke any and all permits granted by it, without notice, if it deems it for the best interests of the public peace, health and safety of the city and the inhabitants thereof. (Prior code § 7018)

9.40.110 Obstructing street or sidewalk—Crowds.

Any number of persons gathered together in one place so as to interrupt the free passage or travel on any of the sidewalks or pavements in the city is declared to be a nuisance, and all such persons shall be liable to arrest alike and punished for committing a nuisance. (Prior code § 5419)
