SOLICITATIONS ON RESIDENTIAL PROPERTY

5.36.010 Peddlers or solicitors may be invited--Conditions.

It is declared to be the policy of this city that the occupant or occupants of the residences in this city shall make the determination of whether peddlers, as defined in Section 5.12.010 D of the Kerman Municipal Code, or solicitors, as defined in Section 5.12.010 E of the Kerman Municipal Code, shall be, or shall not be invited to their respective residences.

A. Notice Regulating Soliciting.

1. Every person desiring to secure the protection of the regulations contained in this chapter shall comply with the following requirements:

2. Notice of the determination by the occupant of giving invitation to peddlers or solicitors, to any residence, shall be given by notice posted on the premises in the manner following:

"No Peddlers or Solicitors Invited"

3. The letters shall be at least one-half inch in height.  For the purpose of uniformity, the cards shall be provided by the city to persons requesting them, at cost.

4. Posting of this card shall constitute sufficient notice to any solicitor of the determination by the occupant of the residence of the information contained on it.

B. Duty of Peddlers or Solicitors.

1. It shall be the duty of every peddler or solicitor, upon going onto any premises in the city on which a residence is located, to examine and look for the notice provided for in subsection A of this section, if any is posted, and be governed by the statement contained on the notice.  If the notice states:  "No Peddlers or Solicitors Invited," then the peddler or solicitor shall immediately and peacefully depart from the premises.

2. Any peddler or solicitor who has gained entrance to any residence, whether invited or not, shall immediately and peacefully depart from the premises when requested to do so by the occupant.

C. Uninvited Peddling or Soliciting Prohibited.  It is declared to be unlawful and shall constitute a nuisance for any person to go upon any premises and ring the doorbell upon or near any door, or create any sound in any other manner calculated to attract the attention of the occupant of a residence, for the purpose of securing an audience with the occupant and engage in soliciting as in defiance of the notice exhibited at the residence in accordance with the provisions of subsection A of this section.

D. Violation--Penalty.  Any person, firm or corporation violating any provision of this chapter shall be fined not less than five dollars nor more than five hundred dollars for each offense, and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues.  (Ord. 91-01 §1(part), 1991:  prior code §5-301).

5.36.020 Exemptions.

The provisions of Section 5.36.010 shall not apply to or include farmers, poultry men, or horticulturalists who are selling exclusively their own produce grown and raised by them; nor shall the same apply to any person granted a permit pursuant to Chapter 5.24 pertaining to the soliciting of charitable contributions.  (Ord. 91-01 §1(part), 1991:  Ord. 146 §1, 1965:  prior code §5-302).
