17.48.010 Purpose.

The purpose of this district is to provide sites for a wide range of commercial and office uses which are diverse, visually pleasing, convenient in terms of parking and access, attractive and used by citizens of Kerman as well as visitors to the area.  (Ord. 90-02 §2(part), 1990).

17.48.020 Permitted uses.

Permitted uses in this district are as follows:

Administrative, business, medical, governmental and professional offices;

Apparel and shoe stores, shoe repair, and tailor and dress shops;

Appliance sales and service, radio and television stores;

Art, antique, gift, novelty and souvenir stores;

Bakery, donut shop and candy store;

Barber and beauty shops;

Bicycle shop;

Book and magazine stores;

Cafes;

Cleaners and tailors;

Clubs and lodges;

Computer store;

Confectionery store;

Convenience store;

Dairy products store (ice cream and yogurt);

Department store;

Drive-in restaurants;

Drug store;

Fire station;

Fitness center;

Floral shop;

Food store, delicatessen, and meat market;

Floor covering, drapery, and carpet cleaning;

Funeral parlors and mortuaries;

Furniture and household appliances, paint and wallpaper;

Garden supply store and nursery;

Hardware store;

Hobby and art supplies;

Interior decorating shops;

Gunsmith shop;

Jewelry, including watch repair, stamp and coin shops;

Laundromats;

Locksmith;

Music and toy stores;

Music and dance instruction;

Newsstand, stationery shop and bookstore;

Pet shop and grooming;

Photography store and studio;

Picture framing;

Printing, duplicating, lithography and blue-printing;

Plumbing fixtures and paint store (retail sale);

Police station;

Post office;

Public or private parking lot;

Office supply store;

Restaurant, soda fountain, cafeteria;

Service station;

Sporting goods store;

Telephone and telegraph office;

Television and radio stations;

Tobacco store;

Travel agency or ticket bureau;

Variety store;

17.48.030 Conditional uses.

Conditional uses in this district are as follows:

Alcohol beverage sales;

Auto lease and rental;

Automobile, motorcycle, and small engine repair;

Automobile service station;

Auto sales, new and used;

Boarding or rooming facilities;

Bowling alleys;

Bus depots;

Cabinet shops;

Card rooms;

Carwash;

Churches;

Drive-through facility;

Equipment sales and rental;

Feed and seed store;

Friction shop;

Furniture upholstery shops;

Glass, radiator, tire and muffler shops;

Hotel and motel;

Hospital;

Library;

Massage establishments as defined in Section 9.27.030;

Multiple-family residential dwellings (R-2 and R-3 district);

Outdoor sales, dining, and storage;

Second-hand store;

Sign shops;

Theater and auditorium;

Utility yards;

Veterinary offices with enclosed boarding structure;

17.48.040 Development standards.

The following development standards together with applicable standards specified in Chapter 17.78 shall apply to all land and structures within this district.

A.    Minimum Lot Size.  The minimum lot size for newly created parcels that are without existing structures shall be six thousand square feet.  There shall be no minimum lot size for parcels which contain existing structures.

B.    Height Limitation.  The maximum height of any structure shall be thirty-five feet.  Structures up to sixty-five feet may be permitted with, a conditional use permit.

C.    Yards.

1.    Front yard:

a.    Parcels fronting Madera Avenue north of Kearney Boulevard shall have a front yard setback of ten feet.  Parcels fronting Whitesbridge Road shall have a front yard setback that is sixty feet from the centerline of Whitesbridge.  To the maximum extent possible, this area shall be landscaped.

b.    Buildings on parcels fronting Madera Avenue between California Avenue and Kearney Boulevard shall be set so that at least one-half of the front property line coincides with a building wall.

c.    Parcels that are not in a location addressed in subsection (C)(1)(a) or (b) in this section:  No setback is required.

2.    Side yard:  None.

3.    Rear yard:  There shall be no rear yard setback unless the parcel abuts a residential district in which case, the setback distance shall be ten feet.

4.    Yard areas may be used for parking, loading and driveways.  (Ord. 99-04 §3, 1999; Ord. 96-13 §2, 1996; Ord. 90-02 §2(part), 1990).

17.48.050 Signs.

Signs shall be consistent with the requirements of Chapter 17.76.  (Ord. 90-02 §2(part), 1990).

17.48.060 Fences, walls and hedges.

Fences, walls and hedges shall be consistent with the requirements of Section 17.40.040.  A solid masonry wall not less than seven feet in height shall be constructed along the property line which separates this district from a residential district.  A masonry may not be required when an alley separates this district from a residential district.  (Ord. 90-02 §2(part), 1990).

17.48.070 Parking.

Off-street parking and loading standards shall be consistent with the requirements of Chapter 17.74.  For parcels fronting Madera Avenue between California Avenue and Kearney Boulevard, parking lots, to the extent possible, shall be located to the rear of buildings.  To the extent possible, access to the parking lots shall be from the alley.  No portion of the parking lot shall be located between the building and the front property line.  (Ord. 96-14 §1, 1996:  Ord. 90-02 §2(part), 1990).

17.48.080 Accessory structures.

Construction of accessory structures within this district shall be consistent with the standards established in Chapter 17.62.  (Ord. 90-02 §2(part), 1990).

17.48.090 Site plan review.

A site plan for new construction of permitted uses within this district shall be submitted to the city planner in accordance with Chapter 17.14.  Construction that increases the square footage or the number of units by more than fifty percent shall also require site plan review.  (Ord. 90-02 §2(part), 1990).
