17.52.010 Purpose.

The purpose of this district is to provide areas in the community for light industrial and heavy commercial types of activities; protect industrial areas from the intrusion of incompatible types of land uses; adhere to performance standards provided for the protection of Kerman residents and the environment; and, accommodate industrial employment opportunities for residents of the city of Kerman.  (Ord. 90-02 §2(part), 1990).

17.52.020 Permitted uses.

The following uses shall be permitted in this district to the extent that the following conditions are not associated with the use:  (1) The use does not involve the disposal of wastewater which, due to its content or flow, will have a significant impact on the Kerman wastewater treatment plant; (2) The use would place a significant demand on Kerman’s water system.  The term "significant" shall be determined by the city engineer after a review of the use’s water demand and wastewater treatment requirements.

Agricultural uses;

Auto repair shops, including body shops, service and supply, rental and parts sale;

Bus depots, transit stations, truck terminals and freight forwarding terminals;

Carpet and rug cleaning plants;

Cleaning and dyeing plants;

Cold storage plants;

Communications equipment buildings and structures;

Contractor’s storage yard;

Electric motor rebuilding shops;

Electrical transmission and distribution substations;

Equipment rental yards;

Farm equipment sales, storage and repair;

Feed store;

Friction shops;

Glass shops;

Kennels, animal hospitals and shelters;

Lumber yards;

Machinery shops, but no punch presses over twenty tons or drop hammers;

Muffler shops;

Radiator shops;

Recreational vehicle and travel trailer storage facilities;

Tire shops;

17.52.030 Conditional uses.

Conditional uses in this district are as follows:

All uses listed in the CS district, except as otherwise listed in this chapter;

Baled cotton storage;

Cement processing, including concrete mixing and batching;

Feed, grain and flour mills;

Mobile office structures;

Recreational uses conducted indoors;

Storage, sorting, collection or baling of metal, paper, glass or plastic product;

Storage of bottled gas, fuel, agricultural chemicals, petroleum products, and other chemicals, not including radioactive material;

Used lumber and material yards;

Uses requiring construction of buildings or accessory structures in excess of thirty-five feet in height.

A conditional use permit shall be required for any permitted use which has one or more of the following characteristics:

1. The use has more than twenty-five employees on the maximum work shift, the building or buildings have gross floor area of over seventy-five thousand square feet or the gross developed area of the industrial site is over ten acres;

2. The use stores, processes, repairs or sells used or reclaimed materials, goods or equipment;

3. The use involves demolition or wrecking activities;

4. The use involves manufacturing or processing activities which are not conducted within an enclosed building or structure;

5. The use involves the storage, use or production of hazardous materials, including any material that, because of its quantity, concentration, or physical or chemical characteristics, poses a significant present or potential hazard to human health and safety or to the environment.  Hazardous materials include, but are not limited to, hazardous substances, hazardous waste, and any material which a handler or the planning director has a reasonable basis for believing would be injurious to the health and safety of persons or harmful to the environment if released into the workplace or the environment.  These criteria shall only apply to uses for which a business plan is required pursuant to Chapter 6.95 of the California Health and Safety Code, "Hazardous Materials Release Response Plans and Inventory."

The definition of a hazardous waste or substance shall be governed by that chapter.  (Ord. 95-06 §3, 1995; Ord. 90-02 §2(part), 1990).

17.52.040 Development standards.

The following development standards together with applicable standards specified in Chapter 17.78 shall apply to all land and structures within this district.

A. Minimum Lot Size.  The minimum lot size for each building shall be six thousand square feet.

B. Height Limitation.  The maximum height of any structure shall be forty-five feet.

C. Yards.

1. Front yard:  ten feet.

2. Side yard:  none, except where the side yard abuts a residential district in which case, the setback distance shall be fifteen feet.

3. Rear yard:  none, except where the rear yard abuts a residential district, in which case the setback distance shall be fifteen feet.

D. Storage.  The rear and side yards of this district can be used for parking and storage.  Where the yard is adjacent to a residential district, material and equipment shall not be stacked higher than six feet.  (Ord. 01-06 § 1, 2001; Ord. 90-02 §2(part), 1990).

17.52.050 Accessory structures.

Construction of accessory structures within this district shall be consistent with the standards established in Chapter 17.62.  (Ord. 90-02 §2(part), 1990).

17.52.060 Signs.

Signs shall be consistent with the requirements of Chapter 17.74.  (Ord. 90-02 §2(part), 1990).

17.52.070 Fences, walls and hedges.

A. The maximum height of fences, walls and hedges shall be seven feet except in the required front yard where the maximum height shall be four feet.  Where a parcel abuts a residential district a seven-foot solid block, masonry or brick wall shall be erected on the property line between the two districts.

1. Construction of fences in excess of seven feet may be approved through a special use permit process described in Section 17.78.070(F).

B. Chain-linked fences with barbed wire are permissible in this district, except where the district abuts a residential district.  The chain-link portion of the fence shall be at least six feet high plus the additional height of the barbed wire.  (Ord. 90-02 §2(part), 1990).

17.52.080 Parking.

Off-street parking and loading shall be consistent with the requirements of Chapter 17.74.

For light industrial uses not specifically identified in Chapter 17.74 parking shall be provided at a ratio of at least one space for every permanent employee on the maximum work shift, one space for each truck operated by the concern and one space for each sales person permanently employed.  (Ord. 90-02 §2(part), 1990).

17.52.090 Performance standards.

Development shall be consistent with the requirements of Chapter 17.78.  (Ord. 90-02 §2(part), 1990).

17.52.100 Site plan review.

A site plan shall be submitted to the planning department for approval in accordance with the provisions of Chapter 17.14 before any building, structure, or sign is erected or any parking facilities are developed on any lot within this district.  This provision shall also apply to any existing operation within the district that is expanding its building or activity by fifty percent or more in area or use.  (Ord. 90-02 §2(part), 1990).
