9.04.010 Dogs – License required.

(A) Any person residing within the corporate limits of the City of Mt. Shasta, owning or having custody or control of one or more dogs, shall pay for the privilege of keeping such dog or dogs an annual license fee for each dog over the age of four months.

(B) Senior citizens, 62 years of age or more, shall be permitted to purchase the aforementioned license for a reduced fee. No discount is allowed for an unaltered dog.

(C) The fee schedule for animal licenses and services shall be set by City Council resolution. (Ord. CCO-05-04, 2005; Ord. CCO-96-07 § 50, 1996; Ord. 376 § 2, 1980)

9.04.020 Animals and poultry – Permit required – Keeping regulations.

(A) It is unlawful for any person to keep animals or fowl named in this chapter within the corporate limits of the City of Mt. Shasta without first obtaining an annual license fee permit from the city. A fee, the amount of which shall be set by City Council resolution, shall be paid on the issuance of the permit. The permit shall apply to the applicant’s premises. The applicant shall state he has read this chapter.

(B) It is unlawful for any person to keep a horse, cow, calf, sheep, rabbit, mule, goat, swine, or other animal or a chicken, pigeon, goose, duck or other poultry in such a manner as to create a condition or conditions which are favorable for fly breeding, odor production and/or any other nuisance or condition or conditions which is detrimental to the public health, welfare, or well-being of the residents of the community.

(C) Any yard, lot, field, or area used for penning, holding or keeping of livestock, animals, or poultry for any purpose shall be maintained in a clean and sanitary manner at all times as ascertained by the Public Health Officer.

(D) It is unlawful for any person to keep any “large animal,” as defined in MSMC 18.08.515, within the City limits unless a conditional use permit is obtained pursuant to MSMC 18.20.140, and no more than one such “large animal” is kept per acre of property.

(E) It is the duty of the Health Officer or his representative or any peace officer within the City of Mt. Shasta to enforce this chapter. (Ord. CCO-11-04 § 1, 2011; Ord. CCO-05-04, 2005; Ord. 376 § 3, 1980)

9.04.030 License and permit requirements.

(A) Such annual license tax or permit shall be due and payable to the City of Mt. Shasta on the first day of July of each year and shall be delinquent 30 days thereafter; provided, however, that new residents of the City of Mt. Shasta owning or having custody or control of a dog or dogs, other animals or fowl, required to be licensed, shall have 30 days after taking up residence in which to obtain such license or permit.

(B) A late registration penalty fee shall be assessed in addition to the regular license tax or permit for failure to register.

(C) The full amount of the license fee or permit and the late registration fee shall be payable for any fraction of any year.

(D) All dogs under four months of age shall be confined to the premises or kept under physical restraint by the owner, keeper, or harborer. Nothing in this section shall be construed to prevent the sale or transportation of a puppy four months or younger.

(E) Each license or permit issued pursuant to the provisions of this section shall be signed by the City Clerk or persons designated by the City Clerk and shall state the name and resident address of the person to whom issued, the date when issued, the expiration date and the number of the tag or permit.

(F) The City Clerk shall keep a record of all licenses or permits so issued. With dog licenses there shall be issued a metal or plastic tag with the number thereof and the year issued together with the reference to the City of Mt. Shasta.

(G) Such dog tag shall be securely affixed to a collar, harness or other device and shall at all times be worn by such dog except while such dog remains indoors or in an enclosed yard or pen.

(H) The City Clerk or person designated by the City Clerk shall procure the number of tags necessary each year and shall keep a file wherein there shall be entered the name and address of the person to whom each such license and tag is issued, the number of such tag, the date of issuance and a description of the dog for which issued.

(I) No person shall attach to or keep upon any dog any tag provided for in this section except the tag issued for such dog.

(J) No person keeping any fowl or keeping or harboring a dog or other animal for which a permit or license is required shall fail or refuse to exhibit said license tag or permit required by this chapter upon demand of the City Clerk or his duly authorized agent or any member of the Police Department of the City of Mt. 9.04.040 Dogs – Entering recreation areas prohibited – When.

9.04.041 Animals prohibited in areas designated by the City Manager.

The City Manager may order the exclusion of animals from City streets and sidewalks during such times as the City Manager deems the presence of animals would constitute a threat to the public health, safety and welfare. It shall be unlawful for any person who owns, controls or has possession of any animal to permit such animal to enter areas designated by the City Manager to be free of animals for such a period of time as the City Manager’s designation applies. 9.04.050 Dogs – Leash required – When.

Persons owning or having control of dogs must keep such animals upon a leash at all times when such animals are upon public streets, alleys, sidewalks or other public places within the City of Mt. Shasta. (Ord. 376 § 7, 1980)

9.04.060 Dogs – Muzzle required – When.

Any person owning or having under his control any dog known to be of a vicious nature must have such dog securely muzzled except when such dog is in a secure enclosure. (Ord. 376 § 8, 1980)

9.04.070 Dogs – Rabies vaccination requirements.

(A) Each person owning a dog over the age of four months shall have such dog vaccinated biannually with rabies vaccine (killed virus vaccines) by a veterinarian. Vaccination with nerve-tissue rabies vaccine shall not be acceptable.

(B) No dog shall be required to be vaccinated against rabies while such dog is afflicted with an illness which, in the opinion of a veterinarian, may be aggravated by the administration of the rabies vaccine. Such an ill dog shall be strictly confined to the premises of, or kept under physical restraint by, the owner thereof for the duration of the illness. Immediately following the termination of the illness, the dog shall be vaccinated in accordance herewith.

(C) The dog vaccination tag issued by the veterinarian to the owner of the dog shall be securely attached to the collar which shall be permanently worn by the dog for which the tag was issued.

(D) Vaccinations for rabies shall be required every three years for dogs two years old or older. A person or persons responsible for having their dog vaccinated for rabies shall be allowed a seven-day grace period from expiration of date. (Ord. CCO-05-04, 2005; Ord. 376 § 10, 1980)

9.04.080 Stray/diseased animals put in care of Humane Society.

(A) The City herewith reserves the right to place stray or diseased animals in the care of the Siskiyou Humane Society. The owners of said animals shall be required to pay a fee to the City for each such impounded animal, and an additional fee for the first night and for each additional night that an animal is cared for by the aforementioned Society. The owner of any diseased or injured animal that is euthanized by the Society shall pay the City the incurred costs for the euthanization and disposal of each owned animal which the City has placed in the care of the Society.

(B) Owners may redeem dogs placed with the Society when the owner shows proof of payment of fines, of rabies vaccination, and further that the dog has a current City dog license. (Ord. 9.04.100 Violation – Penalty.
