3.12.010 Area established.

A business improvement area be, and hereby is, established in the City pursuant to the provisions of the Parking and Business Improvement Law of 19791. (Ord. 86-4, 7-24-1986)

3.12.020 Boundaries.

The boundaries of the proposed area shall be all the territory within the boundaries of the City as is shown on the official map or plat thereof on file in the office of the City Clerk of the City, to which map or plat reference is hereby made and which shall govern for all details. 3.12.030 Surcharge assessed.

The system of assessments or charges to be imposed is the levying of a 50 percent surcharge of all business license taxes in the City except those paid by a home occupation, to be collected at the same time and in the same manner as the business license tax paid. (Ord. 90-21, 11-13-1990)

3.12.040 Use of revenue.

The use of the revenue collected is governed by Streets and Highways Code Section 36500. Expenditures shall meet the initial intent of the surcharge by providing for physical improvements of the district. Authorized uses are:

A. The acquisition, construction or maintenance of parking facilities for the benefit of the area.

B. Decoration of any public place in the area.

C. Promotion of public events which are to take place on or in public places in the area.

D. Furnishing of music in any public place in the area.

E. The general promotion of business activities in the area. (Ord. 2001-3 § 1, 9-11-01; Ord. 86-4, 7-24-1986)

3.12.050 Businesses subject to amendments.

The businesses in the business improvement area established by this chapter shall be subject to any amendments to the Parking and Business Improvement Area Law of 1979. (Ord. 86-4, 7-24-1986)

3.12.060 Procedure for changes.

Changes made in the assessment or charges or in the uses to which the revenue shall be put as specified herein shall be made by ordinance adopted after a hearing and before the City Council. (Ord. 86-4, 7-24-1986)

3.12.070 Review, changes or modifications.

The City Council shall review the assessments or charges or the uses to which the revenue shall be put not later than two years from the effective date of the ordinance codified in this chapter and the determination shall be made regarding changes therein or modification of the boundaries, or this establishment of the area. 3.12.080 Designation of an advisory committee.

Pursuant to Government Code Section 36503 the City Council shall create a five-member advisory committee, whose purpose is to make recommendations as to the expenditures of these funds. The committee shall be comprised of two members from the Newman Chamber of Commerce, two local merchants (doing business in the District) who are not Chamber members and one member of the City Council. The City Council shall have sole discretion relating to expenditure of revenues derived from these surcharges. (Ord. 2001-3 § 2, 9-11-01)
