5.06.010 Purpose.

To provide for commercial centers which generate moderate levels of vehicle traffic and which concentrate on serving the local community. Businesses in the Retail Commercial District are designed as commercial centers, rather than as commercial strips. Some visitor-serving uses and uses that are not entirely enclosed in a building may be allowed provided they are designed to function as part of a commercial center. (Ord. 97-17, 10-28-1997)

5.06.020 Permitted uses.

The following uses, and uses determined to be similar, shall generally be permitted in the Retail Commercial (C-1) Zoning District when conducted entirely within a building:

Appliance, carpet, fabric, furniture, and flooring sales.

Art, craft and music stores.

Auto parts and accessories, sales only.

Automobile sales and related service.

Bakery, donut, and ice cream shops.

Banks and financial institutions.

Barbershops, beauty shops and similar personal services.

Bicycle sales and service.

Book, card, and stationery stores.

Business and professional offices.

Camera shops.

Clothing and apparel stores.

Delicatessens.

Drugstores.

Dry cleaners and laundries.

Equipment and party rental, indoor only.

Florist shops.

Gift and novelty stores.

Glass, hardware, paint, plumbing, wallpaper, heating, and electrical stores.

Jewelry, watch, and clock sales and related servicing.

Laundromats, self-service.

Liquor stores.

Medical and dental offices and clinics.

Music and dance studios and schools.

Newspaper and magazine sales.

Optical goods sales and service.

Pet stores and supplies.

Photography supply and/or studios.

Physical fitness studios, health clubs and spas.

Public and semi-public offices and institutions, including City Hall, Police Department and U.S. Post Office facilities.

Public and semi-public utility uses, except corporation, service, or similar yards.

Restaurants, except fast food restaurants and those with drive-through service.

Shoe stores and shoe repair shops.

Sporting goods stores.

Stereo, television and car phone sales and installation.

Supermarkets and food stores.

Television, radio, electronics and appliance repair.

Travel agencies.

Variety and department stores, including furniture.

5.06.030 Accessory buildings and uses –Administrative approval required.

The following accessory buildings and uses shall be permitted in the Retail Commercial (C-1) Zoning Districts subject to administrative approval:

A. Accessory uses and buildings customarily appurtenant to a permitted or conditional use, such as incidental storage facilities.

B. Signs which pertain only to a permitted or an approved conditional use located on the premises.

C. Temporary buildings and uses as provided in Chapter 5.22 NCC. (Ord. 97-17, 10-28-1997)

5.06.040 Conditional uses – Commission approval required.

Any principal permitted use which is not conducted entirely within a building shall be required to obtain a conditional use permit. In addition, the following uses, and uses determined to be similar, may be permitted in the Retail Commercial (C-1) Zoning District subject to approval of a conditional use permit:

Auto repair, auto body shop and/or auto paint shop.

Automobile sales and related service not entirely contained within a building.

Automotive parts and accessories, sales and service.

Bars, taverns, nightclubs, and cocktail lounges.

Bowling alleys and skating rinks.

Car and truck rentals.

Car washes, automatic and self-service.

Card, pool and billiard rooms and arcades.

Churches and other religious institutions.

Convenience food stores and markets, with gasoline filling stations.

Electronic or mechanical game centers.

Equipment or party rental with outdoor storage.

Fast food restaurants and restaurants with drive-through service.

Gasoline filling stations, with or without auto service.

Hotels and motels.

Mini-storage facilities.

Motorcycle sales and service, new and used.

Off-street parking lots, when not serving a use located on the site.

Parking lots, and/or garages.

Pet clinic (or animal hospital) with no overnight boarding.

Print shops.

Private clubs, lodge halls and meeting facilities.

Secondhand shops.

Warehousing.

Wholesale operations primarily serving the local community.

Residential care facility, small, located in buildings previously used for residential purposes or in the rear of buildings or above the ground floor.

Residential uses which are compatible with the Retail Commercial District such as residential uses in buildings previously used for residential purposes, owner-occupied residential uses located in the rear of buildings or above the ground floor. (Ord. 2016-3 § 7, 7-12-2016; Ord. 97-17, 10-28-1997)

5.06.050 Property development standards.

The following standards shall apply to all land uses, development and subdivisions in the Retail Commercial (C-1) Zoning District:

A. Minimum lot area: 2,500 square feet.

B. Minimum lot width: 25 feet.

C. Minimum front yard setback: None required unless adjacent to a residential zoning district or alley. In such instances, a 10-foot front yard setback is required.

D. Minimum rear yard setback: None required unless adjacent to a residential zoning district or alley. In such instances, a 10-foot rear yard setback is required.

E. Minimum side yard setbacks: None required unless adjacent to a residential zoning district. In such instances, the minimum side yard setback shall be 10 feet.

F. Maximum Floor Area Ratio (FAR). The floor area ratio shall not exceed 0.40.

G. Minimum landscaped area: Five percent of the total lot area.

H. Maximum building height: 35 feet.

I. Architectural and Site Plan Review. Where new construction is proposed, architectural and site plan review shall be required prior to issuance of a building permit.

J. Other Applicable Provisions. Other provisions of this title as applicable such as off-street parking and loading, signs, landscaping and screening, trash enclosures, etc. (Ord. 97-17, 10-28-1997)
