5.08.010 Purpose.

The purposes of the C-8 Highway Commercial District are to:

A. Permit varied uses of property along the Highway 33 Corridor, an important transportation link.

B. Assure compatibility among the uses along Highway 33 and with existing and future uses in adjacent districts and downtown.

C. Allow for the conduct of:

1. Retail, service and institutional uses not ordinarily found in shopping centers or within the City’s Downtown Core Area.

2. Uses generally dependent on a regional, rather than a local, population for their support.

3. Uses requiring a large land area for successful operation.

D. Encourage development of open, uncrowded, and attractive projects that will enhance Highway 33 and the City. (Ord. 97-17, 10-28-1997)

5.08.020 Permitted uses.

Unless otherwise governed by this title, the following uses shall be permitted in the C-8 Highway Commercial District:

Appliance, carpet, fabric, furniture, and flooring sales.

Art, craft and music stores.

Auto parts and accessories, sales only.

Bakery, donut, and ice cream shops.

Banks and financial institutions.

Barbershops, beauty shops and similar personal services.

Bicycle sales and service.

Business and professional offices.

Delicatessens.

Drugstores.

Dry cleaners and laundries.

Equipment and party rental, indoor only.

Florist shops.

Glass, hardware, paint, plumbing, wallpaper, heating, and electrical stores.

Jewelry, watch, and clock sales and related servicing.

Laundromats, self-service.

Medical and dental offices and clinics.

Music and dance studios and schools.

Newspaper and magazine sales.

Optical goods sales and service.

Pet stores and supplies.

Photography supply and/or studios.

Physical fitness studios, health clubs and spas.

Print shops.

Restaurants, including fast food restaurants and those with drive-through service.

Stereo, television and car phone sales and installation.

Television, radio, electronics and appliance repair.

Travel agencies.

Variety and department stores, including furniture.

5.08.030 Conditional uses – Commission approval required.

The following uses, and uses determined to be similar, may be permitted in the Highway Commercial (C-8) Zoning District subject to approval of a conditional use permit:

Agricultural service, sales, and supplies.

Automobile, boat, recreational vehicle and truck sales and related service, new and used.

Bars, taverns, and nightclubs.

Car/truck rental.

Churches and other religious institutions.

Commercial recreation services and facilities, including, but not limited to:

Miniature golf or amusement parks, playgrounds and similar facilities.

Recreational vehicle or travel trailer parks.

Convenience food stores.

Hotels and motels and related visitor services.

Light industrial and heavy commercial uses and services.

Liquor stores.

Mini-storage facilities.

Permitted commercial uses in excess of a 10,000 square foot floor area.

Private clubs and lodge halls, and meeting facilities.

Public utility buildings, not including equipment and storage yards, warehouses or shops.

Refreshment stands.

Retail stores incidental to the principal use.

Service stations, not including major repair or overhaul.

Veterinarian hospitals. (Ord. 97-17, 10-28-1997)

5.08.040 Accessory buildings and uses – Administrative approval required.

The following accessory buildings and uses shall be permitted in the Highway Commercial (C-8) Zoning District subject to administrative approval:

A. Accessory uses and buildings customarily appurtenant to a permitted or conditional use, such as incidental storage facilities.

B. Signs which pertain only to a permitted or an approved conditional use located on the premises.

C. Temporary buildings and uses as provided in Chapter 5.22 NCC. (Ord. 97-17, 10-28-1997)

5.08.050 Property development standards.

The following standards shall apply to all land uses, development and subdivisions in the C-8 Highway Commercial District:

A. Minimum lot area: 15,000 square feet.

B. Minimum lot width: 100 feet.

C. Minimum front yard setback: None required unless adjacent to a residential zoning district or alley. In such instances, a 10-foot front yard setback is required.

D. Minimum rear yard setback: None required unless adjacent to a residential zoning district or alley. In such instances, a 10-foot rear yard setback is required.

E. Minimum side yard setbacks: None required unless adjacent to a residential zoning district. In such instances, the minimum side yard setback shall be 10 feet.

F. Maximum Floor Area Ratio (FAR). The floor area ratio shall have a maximum FAR of 0.40.

G. Minimum Landscaped Area: 10 percent of the total lot area.

H. Maximum building height: 45 feet.

I. Parking Setback. All parking spaces and drive aisles shall be set back a minimum of 15 feet from a public street right-of-way. The resulting setback area shall be landscaped and maintained.

J. Parking Lot Trees. One parking lot shade tree shall be provided for every five parking spaces.

K. Freestanding Signs. Freestanding signs shall be monument style and no taller than 10 feet.

L. Physical Compatibility. Adequate buffers and/or screening shall be provided for all uses where necessary to ensure physical compatibility with neighboring uses and/or zoning districts.

M. Architectural and Site Plan Review. Where new construction is proposed, architectural and site plan review shall be required prior to issuance of any construction permits and may be conducted as part of the use permit review process. Architectural and site plan review approvals can only be granted subject to a finding that the approval is consistent with the Highway 33 Specific Plan where applicable.

N. Other Applicable Provisions. Other provisions of this title as applicable such as off-street parking and loading, signs, landscaping and screening, trash enclosures, etc. (Ord. 97-17, 10-28-1997)
