5.11.010 Purpose.

The P-Q Zoning District regulations are included to achieve the following purposes:

A. To accommodate the wide range of public, institutional, and auxiliary uses which are established in response to the health, safety, cultural, and welfare needs of the citizens of the City;

B. To organize the assemblage of specific nonprofit and profit public facilities into efficient, functionally compatible, and attractively planned administrative centers in conformance with the General Plan;

C. To establish site plan approval for uses thereby ensuring compatibility with adjacent more restrictive districts;

D. To set aside and protect community “open space” areas throughout the City in furtherance of the City’s General Plan Open Space Element. (Ord. 97-17, 10-28-1997)

5.11.020 Regulations generally.

No building or improvement or portion thereof shall be erected, constructed, converted, altered or enlarged, nor shall any lot or premises be used in the P-Q Zoning District except for one or more of the purposes listed in this chapter and subject to the terms and conditions of this chapter, of the City of Newman’s Development and Improvement Standards, and all other applicable provisions of this title. 5.11.030 Permitted uses.

Buildings and facilities owned, leased or operated by the City of Newman, the Newman Unified School District, Joint Powers Authority or any other district, the County of Stanislaus, the State of California or the Government of the United States which house or accommodate the following uses:

A. Business or service offices within which public information or services are provided.

B. Meeting rooms or similar public facilities.

C. Parks and playgrounds and open space areas.

D. Public utility service facilities.

E. School classrooms, cafeterias, meeting rooms, gymnasiums and other sports facilities, and other school-related facilities.

F. Solid waste collection facilities.

G. Other buildings and facilities which, in the determination of the Planning Commission, are similar public service uses with those listed above. (Ord. 97-17, 10-28-1997)

5.11.040 Accessory buildings and uses – Administrative approval required.

The following accessory buildings and uses shall be permitted in the Public and Quasi-Public (P-Q) Zoning District subject to administrative approval:

A. Accessory uses and buildings customarily appurtenant to a permitted or conditional use, such as incidental storage facilities.

B. Signs which pertain only to a permitted or an approved conditional use located on the premises.

C. Temporary buildings and uses as provided in Chapter 5.22 NCC. (Ord. 97-17, 10-28-1997)

5.11.050 Conditional uses – Commission approval required.

The following uses are permitted in the P-Q Zoning District subject to Planning Commission approval of a use permit:

A. Buildings and facilities owned, leased or operated by the City of Newman, the Newman Unified School District or any other district, the County of Stanislaus, the State of California or the Government of the United States which house or accommodate the following uses:

1. Corporation yards, public works maintenance facilities and similar types of facilities.

2. Dumps, waste disposal and similar facilities.

3. Outdoor storage of refuse, construction material or equipment parking facilities.

4. Wastewater treatment facilities;

B. Civic auditoriums and theaters;

C. Museums;

D. Public parking facilities. (Ord. 97-17, 10-28-1997)

5.11.060 Determination of appropriate use by Planning Commission.

Whenever a use is not listed in this chapter as a use permitted as of right or a use subject to a use permit in the P-Q Zoning District, the Planning Commission shall determine whether the use is appropriate for the Zoning District, either as of right or subject to a use permit. In making its determination, the Planning Commission shall find as follows:

A. That the use would not be incompatible with other existing or allowed uses in the District;

B. That the use would not be determined to the continuing development of the area in which the use would be located; and

C. That the use would be in harmony and consonant with the purposes of the Zoning District. (Ord. 97-17, 10-28-1997)

5.11.070 Special development regulations.

A. All new construction or major structural remodeling proposed within a P-Q District shall be subject to architectural and site plan review.

B. All standards for development in the P-Q District shall be established and set forth as conditions of approval of the required permit. (Ord. 97-17, 10-28-1997)
