R-M MOBILE HOME PARK DISTRICT

5.15.010 Purpose – Establishment.

A. The purposes of an R-M Zoning District are:

1. To provide areas for low-, medium-, and high-density residential living in accordance with locations shown on the General Plan, which offer a variety of dwelling types;

2. To preserve the characteristics of a zoning district while allowing for manufactured housing where compatible;

3. To provide an opportunity for new residential subdivisions to allow for housing that is built on-site and manufactured housing where compatible and with the best interest of the City of Newman.

B. An R-M Zoning District may be established and combined with any other zoning district of the City where it is determined that the lots or parcels within such district are compatible with a residential manufactured housing use. For the purposes of identification, all R-M Districts shall be prefixed by the zoning notation of the district with which they are combined (e.g., an R-M District combined with an R-1 District shall be identified as R-1/R-M) and such notation shall be used on the zoning application, agenda, notices, ordinances and the zoning map. 5.15.020 Regulations generally.

No building or improvement or portion thereof shall be erected, constructed, converted, altered, or enlarged, nor shall any lot or premises be used in the R-M Zoning District except for one or more of the purposes listed in this chapter and subject to the terms and conditions of this chapter, or Chapter 5.16 NCC, Development Regulations, and all other applicable provisions of this title. 5.15.030 Permitted uses.

The following uses are permitted as of right in the R-M Zoning District:

A. Residential manufactured housing;

B. All other permitted uses as of right in the zoning district with which the R-M Zoning District is combined. (Ord. 97-17, 10-28-1997)

5.15.040 Accessory uses – Administrative approval required.

The following uses are permitted in the R-M Zoning District with administrative approval:

A. Home occupations pursuant to Chapter 5.20 NCC.

B. Temporary sales office and/or construction offices, and neighborhood or block parties, fairs or festivals, pursuant to Chapter 5.22 NCC.

C. Sale of produce pursuant to Chapter 5.22 NCC. (Ord. 97-17, 10-28-1997)

5.15.050 Conditional uses – Commission approval required.

All conditionally permitted uses in the zoning district with which the R-M Zoning District is combined can be established subject to the issuance of a use permit. (Ord. 97-17, 10-28-1997)

5.15.060 Minimum lot size.

The minimum lot sizes are those set forth for the zoning district with which the R-M Zoning District is combined. (Ord. 97-17, 10-28-1997)

5.15.070 Lot coverage and open space.

The lot coverage and open space requirements are those set forth for the zoning district with which the R-M Zoning District is combined. (Ord. 97-17, 10-28-1997)

5.15.080 Maximum height.

The maximum height limits are those set forth for the zoning district with which the R-M Zoning District is combined. (Ord. 97-17, 10-28-1997)

5.15.090 Yard and setback requirements.

The yard and setback requirements are those set forth for the zoning district with which R-M Zoning District is combined. (Ord. 97-17, 10-28-1997)

5.15.100 Development standards.

A. General development standards for residential manufactured housing are those set forth for the zoning district with which the R-M Zoning District is combined. The following supplemental standards shall be applied to the R-M District generally:

1. Minimum development site required: Five acres.

2. Minimum average lot width: 100 feet for interior lots and/or corner lots.

3. Minimum Street Frontage. The City Planning Commission shall be responsible for determining the minimum street frontage based on the buildable area of the lot, access requirements and good design. However, in no case shall the Planning Commission approve lots having less than 35 feet of street frontage.

4. Minimum lot area per unit: 2,400 square feet of lot per dwelling unit.

5. Minimum front yard site setback: 25 feet from property line.

6. Minimum rear yard site setback: 10 feet from property line.

7. Minimum side yard site setbacks: 10 feet from the property line.

8. Maximum allowable lot coverage: 60 percent by all structures exclusive of parking areas; 20 percent to be dedicated, preserved and maintained as usable open space for parks, playgrounds and similar uses.

9. Maximum building height: 30 feet.

B. The following supplemental standards are applied to all R-M Zoning Districts combined with or adjacent to any R Zone to assure compatibility with surrounding residential uses.

1. Minimum front yard setback: 25 feet from any R zoned property line.

2. A six-foot high visual screen, as approved by the Planning Commission, shall be provided around all sides of a mobile home park which abuts an established residential use or R zoned district. (Ord. 97-17, 10-28-1997)
