6.03.010 Filing of tentative map.

Tentative maps shall be filed with the Planning Director and shall be processed in accordance with the Subdivision Map Act1 and the provisions of this chapter. The subdivider shall file as many copies of the tentative map as may be required by the Planning Director. (Ord. 90-12, 9-25-1990)

6.03.020 Form of tentative map.

Prior to the presentation of a formal tentative map, the subdivider may present sketches of his proposal to the Commission or to the City Engineer. Tentative maps shall be 18 inches by 26 inches in size.

Every tentative map shall be clearly and legibly reproduced and shall contain the following information:

A. A key or location map on which shall be shown the general area including adjacent property, subdivisions and roads.

B. The tract name or number, date, north arrow, scale and sufficient description to define the location and boundaries.

C. Name and address of record owner or owners.

D. Name and address of the subdivider if different from the owner or owners.

E. Name and business address of the person preparing the map.

F. Sufficient elevations or contours to determine the general slope of the land.

G. The location, name, width, and grade of streets within the subdivision and offered for dedication.

H. The location, name and width of adjoining and contiguous highways, streets, and ways.

I. Location and size of all pipelines and structures existing or to be used in connection with the subdivision.

J. Location and character of existing and proposed utilities.

K. The width, location and purpose of all existing and proposed easements.

L. Lot arrangement, dimensions of all lots and lot numbers.

M. The outline of any existing buildings to remain in place.

N. Location of all trees proposed to remain in place and standing within proposed public rights-of-way.

O. Location of all areas subject to inundation and direction of flow of watercourse. (Ord. 77-19, 5-24-1977)

6.03.030 Statements accompanying map.

A statement shall be presented by the subdivider, in writing, and accompanying the map stating:

A. Proposed use of property. If more than one use, the area, lots, or lot proposed for each type of use shall be shown on the tentative map.

B. Statement of the improvements and public utilities proposed.

C. Proposed plan for drainage.

D. Proposed plan for sewerage and sewage disposal.

E. Provision for water supply.

F. Public areas proposed.

G. Tree planting proposed.

H. Type and location of street lighting proposed.

I. Justification and reasons for any exceptions to the provisions of this title or any other provisions of the City.

J. A copy of restrictive covenants. (Ord. 77-19, 5-24-1977)

6.03.040 Public hearing, notice.

A. The Planning Commission shall hold a public hearing on the tentative map and notice thereof shall be given as provided in Section 66451.3 of the Subdivision Map Act. Any interested person may appear at such a hearing and shall be heard.

B. Whenever a public hearing is held pursuant to this title, notice of the time and place thereof, and a general description of the location of the subdivision, shall be published once in The West Side Index, a local newspaper of general circulation, printed and published in the State. 6.03.050 Expiration of maps and extensions.

A. Expiration Period. The approval or conditional approval of a tentative map shall expire 24 months from the date of such action.

B. Extension. The person filing the tentative map may request an extension of the tentative map, by written application, to the Planning Commission. Said request shall be submitted at any time prior to the date of expiration of the tentative map.

C. Time Limit on Extensions. An extension or extensions of tentative map approval shall not exceed an aggregate of three years. (Ord. 90-12, 9-25-1990)

6.03.060 Appeals.

A. The subdivider may appeal from any action of the Planning Commission with respect to a tentative map to the City Council as provided by Government Code Section 66452.5. Such appeal and the hearing thereon shall be conducted in the manner provided by Government Code Section 66452.5(a) and (b).

B. Any interested person adversely affected by a decision of the Planning Commission may file a complaint with the City Council concerning such decision. Any such complaint shall be filed with the City Clerk within 15 days after the action which is the subject of the complaint and shall be accompanied by a filing fee in a sum to be established by the City Council by resolution. The City Council shall have the authority to waive or refund such fee upon good cause being shown. The City Council may, in its discretion reject the complaint within 15 days or set the matter for public hearing. If the City Council rejects the complaint, the complainant shall be notified of such action. If the matter is set for hearing, the hearing shall be conducted and notice thereof given as provided by Government Code Section 66451.3 and by NCC 6.03.040.

C. Notwithstanding the provision of subsections (B) and (C) of this section, any interested person may appeal any decision of the Planning Commission relative to the provisions of Government Code Sections 66473.5, 66474, 66474.1, and 66474.6 to the City Council. Such appeal and the hearing thereon shall be conducted in the manner provided by Government Code Section 66452.5(a) and (b). (Ord. 77-19, 5-24-1977)

6.03.070 Vesting tentative maps.

A. Filing. Vesting tentative maps shall be filed in accordance with the procedures listed for tentative map.

B. Form of Map. Vesting tentative maps shall be submitted with information required for tentative maps, and the following additional information shall also be submitted:

1. The location of all buildings shall be shown for each lot.

2. Preliminary elevations for all buildings.

3. Completed environmental determination, including mitigation measures contained in the approved or certified environmental document or agreed to by the applicant.

4. Completed soils report for all land within the subdivision, which report shall contain conclusions and recommendations of both a registered civil engineer and licensed landscape architect for the placement of fill, the removal or displacement of soil, the installation of drainage facilities, the construction of building sites and foundations, and the completion of finished grades and soils for the installation of landscaping.

5. If the subdivision of any area is proposed to occur in phases by tract, the location of the proposed tract shall be indicated relative to other adjacent phases or tracts established or proposed to be established.

C. Statements Accompanying the Map. Statements shall be those required for the filing of a tentative map, and the following shall also be required:

1. Reference to documents containing environmental mitigation measures pertaining to the property or project, which have been included in the proposal, or to which the applicant or previous owners or applicants have agreed.

2. A list of all regulations, policies, standards, guidelines and ordinances, including zoning ordinances and applicable zones, currently in effect that have been used to prepare the map which will be used to construct buildings and improvements on the premises.

3. Previous land uses.

4. A report documenting the status of any existing condition with respect to hazardous materials and substances on the site and the risk of exposure via air, soil, water or other conveyance.

5. The effect of participation in any special district, benefit district or any other participation the terms of which may infer any vested right.

D. Expiration, Extension of Map, Vested Rights.

1. Vesting maps shall be valid for the period provided for tentative maps, plus any additional time in accordance with Government Code Section 66452.6.

2. Rights conferred by a vesting tentative map shall expire one year following approval of a final map, plus any time used to complete review of a grading permit or architectural review, if that period of review exceeds 30 days.

3. Requests for extension shall be filed and processed in accordance with provisions established for tentative maps.

E. Appeals. Any person aggrieved by the decision of the Planning Commission on any map, amendment thereto or extension request may appeal to the City Council in the manner prescribed by this chapter. (Ord. 90-12, 9-25-1990)
