DRAINAGE AND SEWER FACILITIES

6.08.010 Payment of fees required.

Prior to filing of any final map or parcel map, the subdivider shall pay or cause to be paid any fees for defraying the actual or estimated costs of constructing planned drainage facilities for the removal of surface and storm waters from the local or neighborhood drainage areas or sanitary sewer facilities for local sanitary sewer areas established pursuant to Section 66483 of the Government Code. 6.08.020 Storm Drainage Area No. 1.

A. The following described property is hereby declared to be “Newman Storm Drainage Area No. 1”:

All that portion of Section 24, Township 7 South, Range 8 East, M.D.B. and M. particularly described as the North 4620 feet (70 chains) of the East 1980 feet (30 chains) and that portion of Section 19, Township 7 South, Range 9 East M.D.B. and M. particularly described as the North 1980 feet (30 chains) West of the West boundary of Highway 33 excepting from said North 1980 feet (a) all land North of the South boundary of Von Renner School, (b) all land North of the South boundary of Spring Street and its Western Extension of Leslie Street, (c) land described as beginning at the intersection of the South line of Inyo Avenue and the Westerly line of Highway 33, thence West 413.14 feet to the East line of 16 foot Moreno Lane,

South 208.5 feet to a property line,

East 218.0 feet along property lines,

North 208.5 feet along property lines to the South line of Inyo Avenue,

East 49.7 feet along said South line to a property corner,

South 244.45 feet along property line,

East 160.0 feet along property line,

South 62.77 feet along property line,

Northeasterly 80.32 feet along property line to Westerly line of Highway 33,

Northwesterly 307.4 feet to the point of beginning.

B. The City Council hereby finds and determines that the subdivision and development of property within Newman Storm Drainage Area No. 1 will require construction of certain drainage facilities as set forth in the drainage plan entitled “Newman Storm Drainage Area No. 1 Drainage Plan” which contains an estimate of the total cost of constructing the local drainage facilities required by the plan therein set forth, and a map of the area showing its boundaries and the location of such facilities.

C. The fees hereinafter set forth are hereby imposed and required for the purpose of defraying the actual or estimated cost of constructing planned drainage facilities for the removal of service and storm drain waters from “Newman Storm Drainage Area No. 1.” The costs are based upon findings by the City Council that subdivision and development of the property within said Newman Storm Drainage Area No. 1 will require construction of facilities described in the Drainage Plan, and that the fees are fairly apportioned with such area on the basis of benefits and conferred on the property proposed for subdivision or on the need for such facilities created by proposed subdivisions and development of other property within the areas.

D. The fees for the construction of said facilities are hereby imposed as follows: $750.00 per acre.

The fee shall be automatically increased $75.00 per year per acre, effective as of March 1st of each year hereafter. Except that consideration in lieu of payment of the fees are hereby authorized.

All fees paid hereunder shall be paid into the Newman Storm Drainage Area No. 1 Facilities Fund and shall be expended solely for the construction or reimbursement for construction of local drainage facilities within the area, or to reimburse the City for the costs of engineering and administrative services to form the district and design and construction of the facilities.

E. Such fees shall be paid by the subdivider prior to the filing of any final map or parcel map in the case of subdivisions and division of land and at the time of issuance of a building permit in all other instances. (Ord. 291, 4-27-1976)
