3.60.010 Established – Composition – Appointments.

A. Established. There is established a city diversity commission.

B. Composition and qualifications. The commission shall consist of nine voting members; one member shall be a commissioner from the city planning commission; a minimum of four of the members shall be residents of the city; and four of the members shall be residents of the city or the owners or employees of a business located within the city and which holds a valid city business license.

C. Appointments. The members of the commission shall be appointed as follows:

1. The member from the city planning commission shall be appointed by a majority vote of the city council on the recommendation of the planning commission.

2. The eight public members each shall be appointed by a majority vote of the city council on the recommendation of the council’s interview and nominating committee. (Ord. 962 § 1, 2023; Ord. 944 § 1, 2021)

3.60.020 Terms of office.

The term of office of the planning commissioner shall be one year. The term of office of the four members who are residents of the city shall be four years. The initial term of office for the three members who are residents of the city or the owners or employees of a business located within the city shall be two years; their successors’ term of office shall be four years. Effective April 2023, the term of office of the fourth member who is a resident of the city or the owner or employee of a business located within the city shall be four years. 3.60.030 Purpose.

The purpose of the commission shall be to act in an advisory capacity to the city council by making recommendations on accessibility, diversity, and inclusion, including, but not limited to:

A. Proposing appropriate diversity, social justice, and equity training;

B. Proactively planning inclusive and welcoming events;

C. Making policy recommendations to the city council regarding diversity and inclusion;

D. Advising the city council on ways to recognize and reaffirm the mission of the council’s inclusion resolution;

E. Working with the civic action commission to propose relevant proclamations; and

F. Liaising with the city’s civic action commission, commission on aging, education commission, and planning commission. (Ord. 962 § 1, 2023; Ord. 944 § 1, 2021)

3.60.040 Compensation – Expenditures.

All members shall serve without compensation. The commission may not employ consultants or incur other expenditures without prior approval of the city council. (Ord. 962 § 1, 2023; Ord. 944 § 1, 2021)

3.60.050 Removal or vacancy of members.

Any member of the commission may be removed from the commission prior to the expiration of his or her term by a majority vote of the council. A vacancy is filled in the same manner as the original appointment. A person appointed to fill a vacancy serves for the remainder of the unexpired term. (Ord. 962 § 1, 2023; Ord. 944 § 1, 2021)

3.60.060 Officers – Staff liaison – Liaison representatives.

A. Officers. The commission shall elect a chair and vice chair from among its members. Each officer shall hold office for one year until the successor of each is elected unless the officer’s term as a member of the commission expires sooner.

B. Staff liaison. An officer or employee of the city designated by the city manager shall serve as staff liaison to the commission for the purpose of recording minutes of commission proceedings, maintaining a continuity of records, and assisting with community outreach.

C. Liaison representatives. The commission shall appoint one member to act as a liaison to the civic action commission, one member to act as a liaison to the commission on aging, and one public member to act as a liaison to the education commission. The member from the planning commission shall act as a liaison to the planning commission. The function of such liaison representatives is to attend meetings of the other commissions as needed and advise the diversity commission of the activities, actions, policies, procedures, and reasons behind the actions of the assigned commission that may bear upon matters under discussion by the diversity commission. 3.60.070 Meetings.

The commission shall establish a regular time and place of meeting and shall hold at least four meetings annually for the purpose established in PHMC § 3.60.030. Special meetings may be called by the chair. These regular and any special meetings shall be conducted in conformance with the Ralph M. Brown Act, Government Code section 54950 and following. 3.60.080 Absence from meeting.

A. If a member of the commission is absent without cause from three successive regular meetings of the commission, the office becomes vacant automatically. The commission shall immediately notify the council of the vacancy.

B. A member is not absent without cause if his or her absence is due to illness or is unavoidable, and the member gives notice to the chair or staff liaison before the day of the meeting that he or she will be absent and the reason for the absence. (Ord. 962 § 1, 2023; Ord. 944 § 1, 2021)

3.60.090 Rules.

The commission may make and alter rules governing its organization and procedures which are not inconsistent with this chapter or any other applicable ordinance of the city. (Ord. 962 § 1, 2023; Ord. 944 § 1, 2021)

3.60.100 Quorum.

A quorum is required for the transaction of official business. Five members of the commission constitutes a quorum for the transaction of business. (Ord. 962 § 1, 2023; Ord. 944 § 1, 2021)

3.60.110 Report to council.

The commission shall report to the city council at least once per year on the activities and actions of the commission. The report may be presented orally during a regular council meeting as part of the published agenda business. (Ord. 962 § 1, 2023; Ord. 944 § 1, 2021)
