6.05.010 Running at large prohibited.

No person shall suffer or permit any fowl or animal in his care or custody, except cats, to run at large at any time within the city. [Code 2000 § 91.01; Code 1981 § 6.04.010.]

6.05.020 Barking dogs – Running at large.

It is unlawful for any person owning, keeping, or harboring or having the care, custody or control of a dog to allow, suffer or permit such dog to bark, howl, growl, yelp or whine to the annoyance of other persons or the disturbance of the peace and quiet of the neighborhood, or to allow, suffer or permit a dog owned by him or in his care, custody or control to be at large upon the streets or other public places or upon the premises of other persons without permission. Any violation of this section is a public nuisance. [Ord. 583, 1980. Code 2000 § 91.02; Code 1981 § 6.04.020.]

6.05.030 Enforcement – Duty of officers.

It shall be the duty of law enforcement officers to apprehend and impound any dog found running at large contrary to the provisions of this chapter. [Ord. 505, 1977. Code 2000 § 91.03; Code 1981 § 6.04.030.]

6.05.040 Impoundment procedures.

(A) Any dog so impounded may be redeemed by the owner within 20 days after the impounding of a dog by reclaiming the dog at the shelter where it is impounded and paying a redemption fee as set by the County Humane Society, to which may be added any and all shelter expenses and medical fees incurred by the registered housing of the animal. The fee and expenses shall be paid to the county humane shelter personnel authorized to receive the payments, who shall thereupon issue a receipt. Upon receipt of the payment, the person in charge of the shelter shall release the dog to the owner.

(B) Impounded dogs not reclaimed within 20 days after being impounded may be placed in suitable homes or destroyed in a humane manner.

(C) The person in charge of the shelter shall keep an accurate record of all impounded dogs, which record shall show the time each dog is impounded, the disposition made of each dog, the owner’s name if known and all other appropriate information. 6.05.050 Penalty.

Any person convicted of violating the provisions of this chapter is guilty of an offense, and upon conviction shall be fined as provided in Chapter 1.15 AMC. [Ord. 583, 1980. Code 2000 § 91.99; Code 1981 § 6.04.070.]
