13.05.010 Definitions.

As used in this chapter the following words mean:

“City” means the city of Coos Bay.

“Person” means any individual, firm or corporation.

“Water board” means the Coos Bay/North Bend water board.

“Watershed” means all property:

(1) Occupied by the distribution system or by the domestic water supply sources by and from which the city or any person or corporation provides water to the city.

(2) Acquired, owned or occupied for the purpose of preserving or protecting the purity of the domestic water supply source.

(3) Acquired, owned or occupied by cities within the areas draining into the domestic water supply source. [Ord. 73 § 1, 1986].

13.05.020 Offenses against the purity of the water supply.

No person shall pollute or endanger the purity of the city water supply by:

(1) Going or trespassing upon the area within the watershed.

(2) Permitting any animal owned, controlled or possessed by the person to run at large or be pastured, kept or maintained within the watershed.

(3) Leaving, keeping or depositing any garbage, refuse, or offensive material within the watershed.

(4) Carrying or discharging a firearm, or killing any animal or fowl within the watershed.

(5) Picnicking, camping, hunting, fishing, smoking or lighting or maintaining a fire within the watershed, except fires authorized by the Coos Bay/North Bend water board.

(6) Driving a motor vehicle in the watershed without written permission from the city manager or the manager of the water board.

(7) Bathing or swimming or placing any article or substance in or so near as to be liable to cause pollution of the lakes, springs, streams, creeks or tributaries in the watershed. [Ord. 73 § 2, 1986].

13.05.030 Regulations for authorized persons.

No employee or contractor of the city or the water board employed in the watershed shall violate any rules and regulations adopted by the city or the board to protect the purity of the water and prevent pollution. [Ord. 73 § 3, 1986].

13.05.040 Pollution prohibited.

No person shall establish or maintain a slaughter pen, stock feeding yards or hog pens, or deposit or maintain any uncleanly or unwholesome substance, or conduct any business or occupation, or allow any condition upon or sufficiently near the sources from which the city water supply is obtained, or where water is stored, or the property or means through which it may be conveyed or conducted so that the water would be polluted or its purity destroyed or endangered. 13.05.050 Defacing signs.

No person shall alter, change, deface, or destroy any sign, warning or notice posted by the city or the water board in the watershed. [Ord. 73 § 5, 1986].

13.05.060 Penalty.

Violation of, or failure to comply with, any provision of this chapter is punishable upon conviction by a fine not to exceed $1,000. Each day that a violation continues constitutes a separate violation of this chapter. [Ord. 73 § 6, 1986].
