NOMINATION AND DECLARATION OF CANDIDACY

2.06.010 Applicability of state law.

Except as otherwise provided in the city Charter and this chapter, the provisions of ORS Chapters 249 and 254 regulating election of candidates to local nonpartisan office shall apply to candidates and elections for city elected offices.  (Ord. 2819 §2(part), 1998)

2.06.020 Petition of nomination--Requirements.

Candidates for the various elective city offices of the city, to be voted on at the biennial elections under the conditions and system prescribed by the laws of the state and of the city, shall be nominated in the manner provided for in said law by nominating petition signed by fifty city electors when the petition is for the office of mayor or councilor at large and by twenty electors residing in the same ward when the petition is for the office of city councilor from that ward.  Nominating petitions must be filed with the city elections official not less than seventy days before the election.  (Ord. 2819 §2(part), 1998)

2.06.030 Candidate endorsement and certification.

A.  Before any petition of nomination to elective city office can be accepted for filing by the city elections official, it shall be accompanied by a written acceptance of nomination signed by the person so nominated and a certification of qualification as required in subsection C of this section.

B.  When making application to fill an elective city office by council appointment, a candidate shall include the certification of qualification pursuant to the requirement of subsection C of this section.

C.  Any person seeking elective city office through petition of nomination or declaration of candidacy shall provide, on a form prescribed by the city elections official, a notarized statement that the person meets the qualifications set forth by City Charter.  (Ord. 2819 §2(part), 1998)

2.06.040 Nomination for more than one office.

No person shall be qualified to accept a nomination or to be a candidate for more than one office to be filled in the same election. (Ord. 2819 §2(part), 1998)

2.06.050 Petition of nomination--Signer’s address required.

Each signer of a petition of nomination shall set forth opposite his name on the petition the residence address shown for his voter registration on the Lane County records or such other information as will allow the determination that the signer is qualified to sign the petition. 2.06.060 Verification of petitions of nominations--Certification of candidacy.

No nomination or application for elective city office is complete until it complies fully with Section 2.06.030.  Candidates filing by petition shall submit signature sheets to Lane County elections official for verification in ample time for the verification process to be completed before submitting the perfected nominating petition to the city elections official.  The city elections official shall accept the perfected nominating petition and verify that the necessary written acceptance and certification have been filed with the petition.  Upon finding that the petition is complete and complies with the law, the city elections official shall place the nominee’s name on the ballot for the position sought.  The nomination must be complete before the date for filing the nomination petition prescribed in Section 2.06.020. 2.06.070 Declaration of candidacy.

A candidate may file a declaration of candidacy as an alternative to a petition of nomination, which declaration of candidacy shall contain the following: 

A.  The name by which the candidate is commonly known.  A candidate may use a nickname in parentheses in connection with the candidate’s full name.

B.  Address information as required by the Secretary of State by rule.

C.  The office for which the candidate seeks election.

D.  A statement that the candidate is willing to accept the election.

E.  A statement that the candidate will qualify if elected.

F.  The signature of the candidate.

G.  A statement of the candidate’s occupation, educational and occupational background and prior governmental experience. (Ord. 2819 §2(part), 1998)

2.06.080 Fee for filing declaration of candidacy.

A person filing a declaration of candidacy shall pay a fee of fifteen dollars which fee shall be tendered at the time of filing of the declaration with the city elections official. (Ord. 2819 §2(part), 1998)

2.06.090 Severability.

The provisions of this chapter are severable.  If a section, paragraph, subdivision, clause, sentence, or provision of this chapter is adjudged by any court of competent jurisdiction to be unconstitutional or invalid, such judgment shall not affect the validity of the remaining portions of this chapter.
