9.34.010 Permit process.

In order to obtain a permit to trap fur-bearing or predatory animals within the city limits a property owner or their agent must submit a written request for said trapping to the Cottage Grove police department.  If the trapping activity occurs during the regular trapping season as established by the Oregon Fish and Wildlife Commission, the police chief or his designee may issue the trapping permit.  If the trapping activity occurs outside the regular trapping season, the request will be forwarded to the Oregon Department of Fish and Wildlife who retains authority to grant or deny the trapping permit.  Permits will only be issued to qualified and approved trappers. 9.34.020 Conditions for permit issuance.

The following conditions shall apply to all permits:

A.  Firearms shall not be permitted.

B.  Traps must be placed in strategically located areas that will minimize their exposure to domestic animals and to people unaware of their presence.

C.  Traps may be set no sooner than one hour before sunset and closed no later than one hour after sunrise of the following day.

D.  Permits shall be issued for terms of fourteen calendar days or less, and they shall specify the begin and end dates.

E.  The permit shall specify the description of the property where trapping may occur and the species to be taken.

F.  Only qualified trappers specified in the permit may engage in trapping activities. (Ord. 2700 §2(part), 1992)

9.34.030 Prohibited conduct.

No person shall:

A.  Alter, borrow, loan or transfer to another person any permit issued by the city pursuant to this chapter.

B.  In applying for a permit issued by the city, knowingly make any false statement of any information required by the application regarding the person in whose name the permit is to be issued.

C.  Possess any permit that has been altered, borrowed, loaned or transferred or for which any false statements were knowingly made in applying therefor.

D.  Apply for or obtain any license, tag or permit issued by the commission when civil damages due pursuant to ORS 496.706 or when moneys due the department from court ordered restitutions for violations of the wildlife laws have not been paid. (Ord. 2700 §2(part), 1992)

9.34.040 Penalties.

Any person who conducts a trapping activity within the city limits of Cottage Grove without a permit or in violation of the terms of the permit shall, upon conviction, be subject to a fine not to exceed five hundred dollars and shall be subject to license and tag forfeiture as provided in ORS 497.415.
