2.40.010 Membership.

A. Commission shall consist of seven members who are not members of the city council, employees of the city.

B. Not more than two members shall be nonresidents of the city.

C. Membership of the commission shall comply with ORS 227.020.

D. Nonresident-appointees shall have resided within the Creswell area for at least six months prior to the time of appointment. [Ord. 494 § 2, 2015].

2.40.020 Term of office – Vacancies.

A. Members of the commission shall be appointed for a term of four years.

B. A member of the commission may be removed by the appointing authority, after three consecutive scheduled meetings without prior arrangement or excuse, after hearing, for misconduct or nonperformance of duty.

C. Any vacancy of the commission shall be filled by appointment, as determined by the mayor, for the unexpired term of the predecessor in the office. [Ord. 494 § 3, 2015].

2.40.030 Presiding members.

A. At its first meeting of each calendar year the commission shall elect a chair and a vice-chair to serve one-year terms.

B. Staff to the commission shall keep an accurate record of all commission proceedings.

C. Members of the commission shall receive no compensation other than authorized expenses. [Ord. 494 § 4, 2015].

2.40.040 Powers and duties.

The commission shall have the powers and duties which are now or may hereafter be assigned to it by the City Charter, ordinances, or resolutions of Creswell and laws of the state of Oregon. [Ord. 494 § 5, 2015].

2.40.050 Meetings.

A. Quorum. A majority of the members of the commission shall constitute a quorum.

B. The commission shall meet:

1. To discuss and decide on new business, as applications are ready for consideration; or

2. If requested by city staff, mayor or the city council.

C. Meetings of the commission shall be open to the public.

D. Continuance. The chair may continue a meeting with a majority vote. [Ord. 494 § 6, 2015; Ord. 264 § 1, 1982].

2.40.060 Conflict of interest and bias.

All members of the commission are public officials and must abide by the ethics laws of the state of Oregon. [Ord. 494 § 7, 2015].
