5.15.010 Purpose.

The purpose of this chapter is to regulate the operators of social games, and provide rules to protect the peace, safety and general welfare of the public. [Ord. 948 § 5, 2016.]

5.15.020 Definitions.

“Social game” means a game, other than lottery, between players in a private business, private club, or in a place of public accommodation where no house player, house bank, or house odds exist and there is no house income from the operation of the game. [Ord. 948 § 5, 2016; Ord. 917 § 1, 2013.]

5.15.030 License requirement, application, issuance, inspection, and revocation.

In addition to the requirements in Chapter 5.05 HMC, an application for a social games license shall comply with all of the criteria in HMC 5.15.040. [Ord. 948 § 5, 2016.]

5.15.040 Review criteria.

A social games license shall comply with the following:

1. The applicant shall be subject to a criminal background check.

a. In considering the criminal background check, emphasis shall be given to any arrests or convictions of crimes of violence, sex offenses, narcotics, alcoholic beverage laws, and fraud.

2. The application shall comply with the provisions of this chapter. [Ord. 948 § 5, 2016.]

5.15.050 Submission requirements.

In addition to the requirements in HMC 5.05.070, an application for a social games license shall include:

1. A photograph taken within 60 days of application submission. The photograph shall be two inches by two inches showing the head and shoulders of the applicant in a clean and distinguished manner.

2. A copy of a valid government issued identification. [Ord. 948 § 5, 2016.]

5.15.060 Performance standards.

1. No form of unlawful gambling is permitted upon the licensed premises.

2. All social games are open to public inspection during all hours of operation.

3. No off-premises signs advertising gambling, card playing, social games or the like are permitted.

4. No person under the age of 21 years is permitted to participate in a social game.

5. No charge is collected from any player for the privilege of participating in a social game.

6. No participant shall be charged a price for any consumer goods which is higher or lower than the price charged for nonparticipants.

7. The social games license shall be posted in a conspicuous place at or near the table(s) where the game is being played.

8. The room or enclosure where a social game is being played shall be open and accessible, and doors leading into the room or enclosure shall remain unlocked during all hours of operation.

9. Social games shall not be played between the hours of 2:00 a.m. and 11:00 a.m. [Ord. 948 § 5, 2016.]

5.15.070 Transferability.

No transfer or assignment of a social games license shall be valid or permitted. [Ord. 948 § 5, 2016.]
