12.10.010 Curbs, gutters and sidewalks required.

As a condition of the issuance of a building permit for new construction within the City of Harrisburg, there shall be included in the permit the requirement that applicants shall construct curbs, gutters and sidewalks along the property. In the event that there are no curbs, gutters or sidewalks within the block in which the new construction is taking place, then the applicant for the building permit shall sign a waiver of remonstrance as to the initiation of any of the aforesaid improvements to the real property, and will consent to the same upon initiation by the City or an adjoining property owner. The waiver of remonstrance shall run with the property and shall bind any successive owner of the real property. [Ord. 574 § 1, 1990; Ord. 570 § 1, 1989; Ord. 557 § 1, 1988.]

12.10.020 Sidewalk construction.

Sidewalks shall be constructed in the public right-of-way providing access to the buildings with the construction of such walks conforming to standard specifications of the City.

Exception: Buildings constructed for industrial use on a site adjacent to an industrial service street, as designated in the City’s official street plan, are not required to construct a sidewalk along such street unless the construction of a sidewalk is necessary to provide a continuous pedestrian way connecting existing sidewalks. 12.10.030 Curb and gutter construction.

Curbs and gutters shall be constructed in the public right-of-way conforming to the standard specifications of the City. [Ord. 557 § 3, 1988.]

12.10.040 Definition.

“New construction” shall be defined as the following:

1. The moving of a dwelling unit to a new location within a lot;

2. The placement of a manufactured home onto a lot;

3. The building of a new dwelling unit;

4. The placement of a dwelling unit that has previously been removed and/or adding to or increasing the number of dwelling units inside an existing building. [Ord. 597 § 1, 1991; Ord. 557 § 3(a), 1988.]

12.10.050 Extension of time.

A request for an extension of time in which to construct curbs, gutters, and sidewalks as required herein may be given by action of the City Council. No extension of time shall exceed a period of six months from the date of the action of the City Council and the request for the extension of time for such construction.
