2.80.010 Board of health established.

Pursuant to authority granted in Section 10-8-61, Utah Code Annotated 1953, as amended, the city council hereby establishes a board of health within and for the city to be known as the Helper City board of health. Said board shall consist of five members, consisting of the mayor who shall be ex officio chairman of the board, and four representative citizens of the city appointed by the mayor with the advice and consent of the council. 2.80.020 Term of office.

The term of office for the mayor shall correspond to his tenure in office. The terms of office of the appointive members shall be for five years and until their successor is appointed, with the terms of the first board so arranged that the term of one member shall expire on December 31st of each year. Vacancies occurring otherwise than through the expiration of terms shall be filled for the remainder of the term in the same manner as the original appointment. [Code 1988 § 12-1-2].

2.80.030 Meetings.

Meetings shall be held at the call of the chairman at such time and frequency as the board determines is necessary for the conduct of business of the board. [Code 1988 § 12-1-3].

2.80.040 Health officer appointed.

The board, with the advice and consent of the city council, may appoint an individual to act as the city health officer to assist the board in the conduct of its responsibilities. The person so appointed may but need not be a member of the board. [Code 1988 § 12-1-4].

2.80.050 Duties and powers.

The board shall have the following duties and powers:

A. To enforce of the provisions of Chapter 8.15 HMC relating to the abatement of public nuisances.

B. To enforce the applicable provisions of Chapter 8.25 HMC relating to the abatement of weeds and unsightly objects.

C. To assist the chief of police in the administration and enforcement of the provisions of Article II of Chapter 9.05 HMC and Section 76-10-101 et seq., Utah Code Annotated 1953, as amended, and similar laws as may be enacted, relating to smoking in public places.

D. To make recommendations to the city council for the promulgation of such health rules, regulations and ordinances, not inconsistent with state law or the rules and regulations of the State Board of Health which, in its opinion, are reasonably necessary to preserve the health of the citizens.

E. To inspect and regulate eating and drinking establishments within the city, and to issue and revoke permits for the operation of such establishments.

F. To cooperate with the district and state health agencies. [Code 1988 § 12-1-5].
