2.87.010 Ratification.

Any and all actions of the ad hoc Helper City library board performed are hereby ratified. [Ord. 2015-2 § 1].

2.87.020 Establishment of board.

There is hereby created and established a library board for the city of Helper, pursuant to Section 9-7-402 et al., Utah Code Annotated 1953, subject to the jurisdiction of the Helper City council. [Ord. 2015-2 § 2].

2.87.030 Number of members.

The board shall be composed of five to nine members. Members will consist of one member of the Helper City council to be designated by the mayor, the library director and between three and seven members to be recommended by the board and appointed by the Helper City council. 2.87.040 Term of office.

Members shall serve a term staggered from one to three years from the annual meeting at which they are nominated by the library board and subsequently appointed by the Helper City council. [Ord. 2015-2 § 4].

2.87.050 Meetings/attendance.

The library board shall meet quarterly, the date and time to be set at the library board’s annual meeting. The annual meeting, which shall be for the purpose of nomination of members and election of officers, shall be held at the regular meeting in January of each year. Every member of the library board shall attend the board meetings unless duly excused or unless unable to attend because of extenuating circumstances. Special meetings may be called by the chair of the library board or at the request of three members, for the transaction of business as stated in the call for the meeting. [Ord. 2015-2 § 5].

2.87.060 Voting.

A quorum for the transaction of business at any meeting shall consist of three members of the library board present in person. [Ord. 2015-2 § 6].

2.87.070 Officers.

There shall be a chair and vice chair elected from the appointed members at the annual meeting of the library board. The chair shall preside at all meetings of the library board, authorize calls for any special meetings, appoint committees, execute all documents authorized by the library board, serve as an ex officio voting member of all committees and generally perform all duties associated with that office. 2.87.080 Powers and authority.

The board shall be responsible to and act as an advisory board to the city council. The board shall:

A. Advise and recommend to the city council on matters relating to the operation of the Helper City Library (the “library”);

B. Act in an advisory capacity of the library to the city council and library director;

C. Abide by applicable ordinances of the city of Helper;

D. Review and recommend policies and procedures regarding the library;

E. Advise library staff;

F. Be responsible for the care and maintenance of library property;

G. Select adequate and proper library materials;

H. Be responsible for the library’s financial operation within the limitations of the city’s budgeted appropriation;

I. Review and approve special requests for the use of library facilities;

J. Attend meetings deemed necessary for promoting the library per the direction of the city council or mayor, consistent with city policies;

K. Recommend to the city council various fines and the amounts to be charged as fees for the use of library facilities;

L. Solicit gifts and donations to the library subject to the approval of the city council;

M. Use its influences for services of the library and the community;

N. Perform all functions and duties required by law and such other and further duties requested of it by the city council;

O. Encourage in every possible way the development and advancement of the public library at local, regional, state and national levels;

P. Participate in advocacy initiatives including, but not limited to, local issues, including funding issues and requests, state advocacy activities and federal advocacy initiatives. [Ord. 2015-2 § 8].

2.87.090 Procedure.

Any and all rules and regulations adopted by the library board, if any, shall be forwarded in writing to the city council. The city council may amend, adopt or reject any such rules or regulations. If any rules or regulations should be rejected, the library board may modify them and submit such modified rules and recommendations to the city council. The city council has final authority over the library board. [Ord. 2015-2 § 9].
