18.20.010 Purpose.

The purpose of this chapter is to ensure that no building or structure shall be erected, moved, added to or structurally altered without a permit issued by the city. (Ord. 06-692 § 1, 2006; Ord. 84-335 § 14.01, 1984)

18.20.020 Application procedure.

A. The clerk-treasurer shall be responsible for receiving all applications for building permits. The clerk-treasurer shall review the application for completeness and transmit it to the planning commission; provided, however, that if the clerk-treasurer determines from the application that the proposed structure is not in compliance with applicable ordinances and codes, she shall deny that application and return the application to the applicant with an explanation of the reasons for denying the application.

B. No building permit shall issue without review by the planning commission and building official as described in this chapter, and no provision of this section shall be construed to impose a duty or obligation upon the clerk-treasurer or her designees to conduct analysis of any permit application for compliance with applicable ordinances and codes. 18.20.030 Planning commission review – Building official review – Resubmission of denied applications.

A. The planning commission shall review the application for compliance with the zoning provisions of this title and any other applicable codes or ordinances.

1. If the commission determines that the proposed structure is in compliance with applicable zoning codes and ordinances, the commission shall transmit a finding of same to the building official, who shall then conduct his own review as described in this section.

2. If the commission finds that the proposed structure is not in compliance with applicable zoning codes and ordinances, the commission shall transmit a finding of same to the clerk-treasurer, who shall then deny that application and return the application to the applicant with a written explanation of the reasons for denying the application.

B. The building official shall review the application for compliance with applicable building codes, and any other applicable codes or ordinances not related to planning and zoning.

1. If the building official determines that the proposed structure is in compliance with applicable building codes and other applicable codes and ordinances, the building official shall then issue a building permit.

2. If the building official finds that the proposed structure is not in compliance with such applicable ordinances and codes, the building official shall then deny that application and return the application to the applicant with a written explanation of the reasons for denying the application.

C. An applicant whose application for building permit is denied by the clerk-treasurer or the building official may resubmit the application; provided, that the proposed structure is modified to meet the requirements of all codes and ordinances. An application that has been resubmitted shall be treated as a new application for purposes of this chapter, except that the commission and building official may rely on prior findings and research in its review of the resubmitted application. 18.20.040 Time limits to begin substantial construction.

Upon receipt of a building permit, substantial construction of the structure must start within 120 days of the issuance of the permit. If substantial construction has not been started within 120 days, the applicant must submit a request for extension of the permit. (Ord. 06-692 § 1, 2006)
