2.84.010 Board created.

There is hereby created a city of Battle Ground law enforcement officers and firefighters disability board. The word “board” shall be deemed to mean the city of Battle Ground law enforcement officers and firefighters disability board whenever used in this chapter. (Ord. 18-01 § 1 (part), 2018)

2.84.020 Board membership.

A.    The membership of the board shall consist of the following five members:

    Two council members to be appointed by the mayor;

    Two active or retired law enforcement officers employed by or retired from the city who are elected by the law enforcement officers employed by or retired from the city who are subject to the jurisdiction of the board; and

    One member from the public at large who resides within the city and who is appointed by the other four members designated in this subsection.

B.    Only those active or retired law enforcement officers who are subject to the jurisdiction of the board have the right to election under this section.

C.    For the purposes of the initial board membership, the appointed council members and the elected law enforcement officer representatives shall meet solely for the purpose of appointing the public-at-large member on or before July 2, 2018. (Ord. 18-01 § 1 (part), 2018)

2.84.030 Terms.

All members appointed or elected pursuant to this section shall serve a two-year term, with the exception of one law enforcement member and one city councilmember who, on the first term, shall only serve a one-year term. All terms shall expire on the thirty-first day of December of the last year for which the term is made; provided, each member shall hold office until a successor is appointed or elected. 2.84.040 Resignation, removal and vacancy.

A.    In accordance with Chapter 42.12 RCW, any member resignation shall be made to the city council and to the board. The vacancy caused by the resignation shall be deemed to occur upon the effective date of the resignation.

B.    Appointed members may be removed prior to the expiration of their term by a majority vote of the city council upon a recommendation made to the city council by a majority vote of the board.

C.    A board position shall become vacant for the same reasons applicable to elective offices in Chapter 42.12 RCW and council positions in RCW 35A.12.060. Prior to a third consecutive absence, a member may request that the board excuse one or more absences. The board shall determine the validity of the request, and approve or deny the request. Vacant appointed positions shall be filled by mayoral appointment and vacant elected positions shall be filled pursuant to the applicable election method set forth in this chapter and RCW 41.26.110. 2.84.050 Officers.

A.    The board shall elect from among its membership a chairperson and vice chairperson, and such other officers as it deems necessary. The term of office shall be one year. Officers shall be elected at the first meeting that occurs on or follows the first Monday in January.

B.    The chairperson shall preside at meetings and shall rule on all points of procedure.

C.    If the office of the chairperson becomes vacant, the vice chairperson shall assume the responsibilities of said office and shall serve in said capacity until the board elects officers during the next term. In the event such a vacancy occurs, the board shall elect a new vice chairperson who shall serve until the board elects officers during the next term. (Ord. 18-01 § 1 (part), 2018)

2.84.060 Meetings.

A.    The board shall hold meetings as necessary for the proper discharge of its duties. The board may postpone or cancel a present or future board meeting.

B.    Meetings of the board shall be open and public pursuant to Chapter 42.30 RCW. The public shall be notified of upcoming board meetings and the preliminary agenda for each meeting. Such notice may include, but is not limited to, written notification to the city’s official newspaper, publication of a notice in the official newspaper, posting of upcoming meeting agendas, or such other processes as the board determines will satisfy the intent of this requirement.

C.    A quorum for conducting business shall be a simple majority of the membership of the Board. (Ord. 18-01 § 1 (part), 2018)

2.84.070 Authority and duties.

A.    The board shall have such powers and duties as prescribed in Chapter 41.26 RCW.

B.    The board shall establish rules, policies, and procedures consistent with the requirements of Chapter 41.26 RCW and Chapter 415-105 WAC. (Ord. 18-01 § 1 (part), 2018)

2.84.080 State law adopted.

To the extent that it is applicable, Chapter 41.26 RCW is adopted by reference, and shall be in effect in the city of Battle Ground. (Ord. 18-01 § 1 (part), 2018)
