3.05.010 Permit fees.

3.05.030 Parks and recreation – Setting and establishing user fees.

(1) The city manager shall review annually the current rates, fees and charges for facilities and programs, and amend them, if necessary, to assure that the city of Burien is providing such services at a reasonable fair market value and consistent with fee policies and goals as recommended by the parks department advisory board.

(2) The city manager is authorized to establish or amend these rates, fees and charges for the following described services:

(a) Senior adult programs, classes and services;

(b) Family program activities, classes and services;

(c) Youth program activities, classes and services;

(d) Facility rentals (e.g., meeting rooms, picnic shelters, etc.); and

(e) Field rentals.

(3) The parks director shall review at least annually the current rates, fees and charges and recommend to the city manager any necessary adjustments. The city manager is authorized to establish or amend these rates, fees and charges.

(4) The director shall set user fees in accordance with this section.

(5) The director shall set user fees for all parks and recreation facilities and programs for which specific users can be readily identified and charged, unless the director determines that the administrative costs to collect the fees are likely to exceed revenues.

(6) In setting user fees, the director shall consider the following, among other factors:

(a) The cost of providing services and the demand for services;

(b) The administrative costs of collecting the fees;

(c) The user’s ability to pay; and

(d) Maximizing nontax revenue for the support of parks and recreation facilities.

(7) User fees for youth shall generally be set lower than comparable fees for adults.

(8) Consistent with applicable law, the director may waive, in whole or in part, user fees or provide or facilitate scholarships for individuals meeting federally established low-income criteria, to help ensure that no one is denied access to parks and recreation facilities or activities based solely on an inability to pay. The director shall adopt rules that establish the circumstances for which these waivers or scholarships are available and the process for granting the waivers or scholarships. In addition, the director may waive user fees as part of a concession, advertising or sponsorship agreement under which the city receives consideration equal to or greater than the total amount of the fees to be waived. The director shall document all waivers of user fees.

(9) The director shall set user fees in a way that clearly and simply states the amounts and the facilities or programs to which the fees apply. The director may set ranges for particular user fees and select fees within those ranges.

(10) The parks director shall maintain a record of the rates, fees and charges assessed and shall provide a copy to the city clerk for audit and accounting purposes and shall publish the most recent listings of the rates, fees and charges in regular publications of the department.

(11) All funds collected from the rates, fees and charges shall be deposited in the general fund of the city. [Ord. 475 § 3, 2007; Ord. 336 § 1, 2001; Ord. 243 § 1, 1998]
