FIRE PREVENTION AND INVESTIGATION DEPARTMENT

1.110.010 Organization and staffing.

The department shall be headed by a fire marshal responsible to the board of county commissioners. Additional personnel staffing and organization shall be as necessary to properly administer federal, state and local requirements. (Res. 2017-83 (Exh. A (part)), 9/25/17).

1.110.020 Authority.

(1)    The fire marshal shall be responsible for fire and life safety inspections, fire and arson investigation, public safety education, plan review for compliance with fire and life safety regulations, and other associated duties, including, but not limited to:

(A)    Administration and enforcement of the International Fire Code, as adopted and amended pursuant to Title 3, and fire protection standards contained in Title 15.

(B)    Investigation of the cause, origin and circumstances of fires and unauthorized releases of hazardous materials.

(C)    Coordination with fire districts and other county departments on code development.

(D)    Community wildfire planning and implementation.

(E)    Conducting enforcement action and proceedings pursuant to Title 16, Enforcement and Violations. In such actions and proceedings, reference in Title 16 to “administrator” shall be a reference to the fire marshal or his/her designee, and reference to “department” shall be a reference to the fire prevention and investigation department.

(2)    The fire marshal may delegate authority, or any portion of authority, as is necessary to perform the fire marshal responsibilities and duties.

(3)    The fire marshal is authorized to promulgate such rules, policies and/or procedures as may be deemed necessary to administer and enforce this chapter. (Res. 2017-83 (Exh. A (part)), 9/25/17).
