8.12.010 At large.

It is unlawful for any chicken or chickens or other domestic fowls to be permitted by the owner or owners thereof to run or remain at large within the corporate limits of the city. All chickens shall be enclosed within a henhouse, coop or chicken tractor at all times. (Ord. 1107 § 2, 2016; Ord. 142 § 1, 1909).

8.12.015 Fowl management.

(a) Chickens may be kept within the city limits of the city of Davenport; provided:

(1) No more than six hens, including chickens and chicks, may be kept per 5,000 square feet in R-1 and R-2 zones.

(2) Chickens shall be allowed only on single-family residential lots containing a maximum of one residence.

(3) No roosters are allowed to be kept in Davenport city limits.

(4) Chickens, except for chicks, shall not be kept inside any residential domicile.

(5) Henhouses, coops and chicken tractors shall be kept at least five feet from all property lines.

(6) Henhouses, coops and chicken tractors shall provide adequate shelter, be kept clean and maintained so that dust, manure and odors are not detectable beyond any property line. When a conflict arises as to the proper care and housing of chickens the standards set forth as found in the January 2009 Humane Farm Animal Care (HFAC) Standards for chickens shall apply.

(7) Henhouses and coops shall provide at least four square feet of space per chicken.

(8) Chicken tractors shall provide at least four square feet of space per chicken.

(9) Henhouses, coops and chicken tractors shall be restricted to the backyard area of a single-family residential lot.

(10) Henhouses, coops and chicken tractors shall be set back from any body of water in compliance with the Lincoln County shoreline management plan and the City of Davenport’s critical areas ordinance as each is currently enacted or hereinafter amended.

(11) Henhouses, coops and chicken tractors shall be set back 100 feet from any public or private well.

(12) Chicken manure shall be managed so as not to create a nuisance. Any such nuisance shall be violation of the city’s nuisance ordinance.

(13) All chicken feed or food set aside for chickens shall be stored in rodent-proof containers and feeders.

(14) All structures used to care for chickens, including henhouses, coops and chicken tractors, shall be maintained in a manner to ensure that rodents are not present.

(15) Any rodent activity in the vicinity of any chicken structure or enclosure shall require the owner of the chickens to eradicate the rodents in compliance with local, state and federal laws. (Ord. 1107 § 2, 2016).

8.12.020 Owner penalty.

Any owner or owners of any chicken or chickens or other domestic fowls mentioned in DMC 8.12.010 who allow the same to run or remain at large within the corporate limits of the city shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable as provided in DMC 1.04.010.
