10.52.010 Definitions.

The following words and phrases, when used in this chapter, shall have the meanings set forth below, unless normal construction in the context shall clearly indicate to the contrary:

A. “Skateboard” has its ordinary meaning and includes a board of any material with wheels affixed to the underside, designed to be ridden by a person. For the purposes of this chapter, the term “skateboard” shall include the terms scooter and coaster.

B. “Riding a skateboard” means standing with one or both feet touching the skateboard, crouching, sitting or lying upon the skateboard while it is in motion.

C. “Roller skate” means a pair of shoes, mounted upon wheels and is most often propelled by the user in an upright, standing position or kneeling.

D. “Roller blade” means a pair of shoes, mounted upon a single-line roller skate or blade, and is most often propelled by the user in an upright, standing position or kneeling.

E. “Scooter” shall have its ordinary meaning and includes a footboard mounted upon or between two or more small wheels and controlled by an upright steering handle. (Ord. 97-9 § 1, 1997)

10.52.020 Prohibited in City Center.

It is unlawful for any person to operate or ride upon a skateboard, rollerskates, roller blades, scooter or coaster upon city streets, sidewalks, or publicly owned parking lots in the City Center of the city of East Wenatchee as bounded by Simon Street on the south, 11th Street on the north, State Route 28 on the west and Eastmont Avenue on the east, including sidewalks on both sides of the street and the sidewalks in between (“City Center”). 10.52.030 Yield to pedestrians.

On any sidewalk outside the City Center, as defined herein, any person riding any skateboard, roller skates, roller blades, scooter or coaster, shall yield the right-of-way to any pedestrian. (Ord. 97-9 § 1, 1997)

10.52.040 Traffic control devices.

Any person operating a skateboard, roller skates or coaster shall obey the instructions of official traffic control signals, signs, and other control devices applicable to vehicles, unless otherwise directed by a police officer. (Ord. 97-9 § 1, 1997)

10.52.050 Violation – Penalty.

Any person violating any provision of this chapter shall be guilty of a traffic infraction and shall be punished by the imposition of a monetary penalty of not more than $50.00. This fine shall not be suspended or deferred, but the court may authorize community service in lieu of all or part of the fine. (Ord. 97-9 § 1, 1997)

10.52.060 Seizure of skateboard.

Whenever a law enforcement officer has probable cause to believe a skateboard was used or is being used in violation of this chapter, such skateboard may be seized as evidence and held until the disposition of the charge. An observation by a law enforcement officer that a skateboard is in motion upon the ground or pavement in the City Center, whether or not such skateboard is accompanied by a person, shall be sufficient to establish probable cause of a violation of EWMC 10.52.020.
