19.50.010 Purpose.

This zoning district is intended to provide opportunities for location of existing and future public facilities and outdoor recreational activities, and to preserve scenic qualities and resources. This district shall include parcels owned by the public, including those used for government services, public schools, and parks, recreation and open space. This includes all government-owned property including, but not limited to, those owned by the city, Pierce County, and the Fife School District. (Ord. 1584-06 § 2, 2006).

19.50.020 Permitted uses.

Permitted uses in the POS district are public uses and publicly owned facilities including, but not limited to:

A. Community centers;

B. Community gardens;

C. Courts;

D. Fire stations;

E. Governmental offices;

F. Hospitals;

G. Museums;

H. Open spaces;

I. Public parking facilities;

J. Parks;

K. Police stations;

L. Pools;

M. Post offices;

N. Public works facilities;

O. Recreation areas and facilities;

P. Senior centers;

Q. Schools;

R. Substations;

S. Utility facilities; and

T. Libraries. (Ord. 1584-06 § 2, 2006).

19.50.030 Accessory uses.

Accessory uses in the POS district are:

A. Accessory buildings and structures in accord with the development standards set forth in FMC 19.50.050.

B. Temporary accessory uses in accord with FMC 19.68.100.

C. Electric vehicle charging station equipped with Level 1 or Level 2 battery charging station equipment only. (Ord. 1780 § 16, 2012; Ord. 1584-06 § 2, 2006).

19.50.040 Conditional uses.

Uses permitted subject to the granting of a conditional use permit are:

A. Any other use similar to those listed in FMC 19.50.020, as determined by the director. (Ord. 1584-06 § 2, 2006).

19.50.045 Prohibited uses.

The following are prohibited uses for the public use/open space district:

A. Marijuana producing.

B. Marijuana processing.

C. Marijuana retailing or marijuana retailers.

D. Medical marijuana collective gardens. (Ord. 1872 § 13, 2014).

19.50.050 Development standards.

A. Minimum Lot Area and Site Requirements. See subsection (B) of this section for additional minimum requirements.

Calculations resulting in a fraction shall be rounded to the nearest whole number with 0.50 being rounded up.

B. Additional zoning district development standards, in accord with FMC 19.68.020, may be required.

C. Limited Access. For noise, safety, traffic and neighborhood character concerns, access to streets with a collector arterial designation or less may be limited or prohibited by the director. For noise, safety and traffic concerns, access to streets with a designation greater than collector arterial may be limited by the director.

D. Parking and Circulation Regulations. Parking, circulation, and loading areas shall be prohibited within the front yard setback area. See Chapter 19.56 FMC.

E. Landscaping and Buffering Regulations. The landscaping plans shall be prepared by a landscape architect registered in the state of Washington. See Chapter 19.64 FMC.

F. Administrative Design Review. An administrative design review will be required of all projects, in accord with Chapter 19.60 FMC.

G. Development Agreements. Development agreements may be considered as provided in FMC 19.68.110.

H. Sewer Hook-Up Requirement. Sanitary sewer hook-ups will be required as provided in FMC 19.68.130.

I. All development must conform to the applicable standards of the Fife Municipal Code.

J. One Legal Lot of Record. Uses within the POS district must be located on at least one legal lot of record, which meets the minimum requirement of this chapter and the development standards elsewhere within the Fife Municipal Code. 19.50.060 Performance standards.

A. Tennis courts, basketball courts and other similar recreational facilities, within 30 feet of a property line, may be required to provide a fence, wall, or similar structure, as determined by the community development director or his designee in order to minimize balls from going onto adjacent property or onto the public right-of-way.

B. Additional Performance Standards. Additional performance standards may be required as provided in FMC 19.68.030. (Ord. 1584-06 § 2, 2006).
