9.10.010 Definitions.

For the purpose of this chapter, certain words and phrases used in this chapter are defined as follows:

A.    “Electronic device” means any electronic equipment amplification of sound, including, but not limited to, radios, stereo systems, boom boxes, sirens, megaphones, and horns.

B.    “Motor vehicle” means any vehicle which is self-propelled by mechanical power, including, but not limited to, passenger cars, trucks, truck trailers, campers, motor homes, motorcycles, minibikes, go-carts, snowmobiles, and racing vehicles.

C.    “Noise” means any sound which annoys or disturbs humans or which causes or tends to cause an adverse psychological or physiological effect on humans.

D.    “Noise disturbances” means any sound which:

1.    Endangers or injures the safety or health of humans or animals; or

2.    Annoys or disturbs a reasonable person of normal sensitivities; or

3.    Endangers or injures personal or real property; or

4.    Interferes with normal conversation at a distance of seventy-five feet or more from the source of the sound.  (Ord. 1081 § 1, 1992)

9.10.020 Vehicle operation--Noise disturbance prohibited.

It shall be unlawful for any person to operate or cause to be operated any vehicle or electronic device in such a manner as to create a noise disturbance.  (Ord. 1081 §2(part), 1992)

9.10.030 Vehicle operation--Exceptions to noise restriction.

Exceptions to Section 9.10.020 include emergency vehicles and/or equipment when operated by authorized personnel or vehicles and/or equipment operated in the process of licensed business activities, or special events authorized by permit or council action.  (Ord. 1081 §2(1), 1992)

9.10.040 Types of unlawful noise designated.

Offenses enumerated include:

(A)    Excessive tire noise;

(B)    Excessive engine noise;

(C)    Excessive exhaust noise;

(D)    Excessive noise derived from use of engine or exhaust brakes;

(E)    Excessive electronic noise.  (Ord. 1081 §2(2), 1992)

9.10.050 Violation--Penalties.

Any person violating any of the provisions of this chapter is guilty of an infraction.  The penalty for the first violation is twenty-five dollars; the second violation is fifty dollars; the penalty for every subsequent violation shall be one hundred dollars.  (Ord. 1081 §2(part), 1992)
