13.96.010 Willful, negligent or malicious damage.

No unauthorized person shall maliciously, willfully or negligently break, damage, destroy, uncover, deface or tamper with any structure, appurtenance, or equipment which is a part of the sewage works. Any person violating this provision shall be subject to immediate arrest under a charge of disorderly conduct. [Ord. 1449 § 1 (Exh. A), 2013; Ord. 680 § 901, 1981.]

13.96.020 Accidental discharge.

Any person found to be responsible for accidentally allowing a deleterious discharge into the sewer system which causes damage to the treatment facilities and/or receiving body of water shall, in addition to a fine, pay the amount to cover damages, both values to be established by the approving authority. 13.96.030 Violation – Notice.

Any person found to be violating any provision of Chapters 13.72 through 13.96 LMC, except LMC 13.80.050, shall be served by the city with a written notice stating the nature of the violation and providing a reasonable time for the satisfactory correction thereof. The offender shall, within the period of time stated in such notice, permanently cease all violations. [Ord. 1449 § 1 (Exh. A), 2013; Ord. 680 § 1001, 1981.]

13.96.040 Continued violations.

Any person, partnership, or corporation, or any officer, agent or employee thereof, who shall continue any violation beyond the notice time limit provided in LMC 13.96.030, shall, upon conviction thereof, forfeit not more than $200.00 together with the costs of prosecution. In default of payment of such forfeiture and costs, the violator shall be imprisoned in the county jail for a period not to exceed 30 days. Each day in which any violation is continued beyond the notice time limit shall be deemed a separate offense. [Ord. 1449 § 1 (Exh. A), 2013; Ord. 680 § 1003, 1981.]

13.96.050 Liability.

Any person violating any provisions of Chapters 13.72 through 13.96 LMC shall become liable to the city for any expense, loss, or damage occasioned by reason of such violation which the city may suffer as a result thereof, including attorney fees.
