TRAFFIC RESTRICTIONS

10.48.005 Avoiding an intersection.

A. It is unlawful for any person operating a motor vehicle within the city to leave a roadway’s marked lanes of travel and proceed across any private property, any publicly owned non-right-of-way property, or parking lot, for the purpose of avoiding an intersection or traffic control device, unless so directed by proper authorities. A presumption shall be permitted that a person operating a motor vehicle that leaves one roadway and enters onto another roadway by crossing private property, any publicly owned non-right-of-way property, or a parking lot, has done so for the purpose of avoiding an intersection where the driver did not stop, significantly change speed, or give other indication of an intent to stop upon said property.

B. This section shall not apply to any police, fire, or emergency vehicle.

C. Any person violating this section, in addition to being deemed to have committed a traffic infraction, shall be assessed a $42.00 base penalty and shall also be subject to public safety and education assessments authorized by Chapter 3.62 RCW as now or hereafter amended, any monetary penalties as provided for in Chapter 46.63 RCW as now or hereafter amended, and any other fees, costs, assessments or penalties as authorized by law for traffic infractions.

D. The provisions of Chapter 46.63 RCW for the disposition of traffic infractions apply to the disposition of all infractions as set out in this chapter. (Ord. 3626 § 1, 2014).

10.48.010 Vehicle traffic prohibited – Pine Street.

Vehicular traffic is prohibited on Pine Street from 1st Street to 2nd Street, except that such prohibition shall not apply to emergency and other authorized city vehicles. (Ord. 2053 § 3(A), 1981).

10.48.015 Vehicle weight restrictions – Sixth Street.

No person shall operate a motor vehicle exceeding 10 tons (20,000 lbs.) gross vehicle weight on Sixth Street between Hazel Street and Blackburn Road; provided, however, that this restriction shall not apply to vehicles traveling on Sixth Street for the purpose of providing service to residential customers, including but not limited to fuel trucks, concrete trucks, moving vans, school buses, garbage trucks, emergency vehicles, etc. (Ord. 2175 § 1, 1985).

10.48.020 Violation – Penalty.

Any person violating any provision of this chapter shall be deemed to have committed a traffic infraction, and upon a final determination of having committed such traffic infraction, such person shall be assessed a monetary penalty not to exceed $250.00 for each offense. (Ord. 2053 § 3(B), 1981).
