16.08.010 Definitions generally.

For the purpose of this title, certain terms and words are defined. When not inconsistent with the context, words used in the present tense shall include the future; the singular shall include the plural and the plural the singular; the word “shall” is always mandatory and the word “may” indicates the use of discretion in making a decision. 16.08.020 Alley.

“Alley” is a strip of land dedicated to public use, providing vehicular and pedestrian access to the rear side of properties which abut and are served by a public street and which may also include provisions for public utilities and drainage. (Ord. 67 § 4(4.12), 1972)

16.08.030 Block.

“Block” is a group of lots, tracts, or parcels within well-defined and fixed boundaries, usually streets. (Ord. 67 § 4(4.09), 1972)

16.08.040 Comprehensive plan.

“Comprehensive plan” is the current comprehensive plan of the city as recognized and adopted by the Ocean Shores city council. (Ord. 67 § 4(4.13), 1972)

16.08.050 Condominium.

“Condominium” means real property, portions of which are designated for separate ownership and the remainder of which is designated for common ownership solely by the owners of those portions. The creation of a condominium shall be regulated by state law. The city shall not impose any requirement upon a condominium which it would not impose upon a physically identical development under a different form of ownership. (Ord. 516 § 2, 1991)

16.08.060 County auditor.

“County auditor” is as defined in RCW Chapter 36.22. (Ord. 67 § 4(4.15), 1972)

16.08.070 County treasurer.

“County treasurer” is as defined in RCW Chapter 36.29. (Ord. 67 § 4(4.14), 1972)

16.08.080 Cul-de-sac.

“Cul-de-sac” is a street closed at one end by a circular drive of sufficient size for turning automotive vehicles around. (Ord. 67 § 4(4.11), 1972)

16.08.090 Dedication.

“Dedication” is the deliberate appropriation of land by an owner for any general and public use, reserving to himself no other rights than such as are compatible with the full exercise and enjoyment of the public uses to which the property has been devoted. The intention to dedicate shall be evidenced by the owner by the presentment for filing of a final plat or short plat showing the dedication thereon; and the acceptance by the public shall be evidenced by the adoption of an ordinance indicating approval of such plat for filing with the county auditor and the city engineer. 16.08.100 Easement.

“Easement” is a grant by a property owner to specific persons or to the public to use land for specific purpose or purposes. (Ord. 67 § 4(4.07), 1972)

16.08.110 Final plat.

“Final plat” is the final drawing of the subdivision and dedication prepared for filing for record with the county auditor and containing all elements and requirements set forth in RCW Chapter 58.17 and in this title adopted pursuant thereto. (Ord. 644 § 1, 1998: Ord. 67 § 4(4.06), 1972)

16.08.120 Lot.

“Lot” is a fractional part of subdivided lands having fixed boundaries being of sufficient area and dimension to meet minimum zoning requirements for width and area. The term shall include tracts or parcels. (Ord. 67 § 4(4.08), 1972)

16.08.130 Planning commission.

“Planning commission” is the Ocean Shores planning commission as established by ordinance. (Ord. 67 § 4(4.16), 1972)

16.08.140 Plat.

“Plat” is a map or representation of a subdivision showing thereon the division of a tract or parcel of land into lots, blocks, streets and alleys or other divisions and dedications. (Ord. 67 § 4(4.02), 1972)

16.08.150 Short plat.

“Short plat” is a map or representation of a short subdivision. (Ord. 67 § 4(4.04), 1972)

16.08.160 Short subdivision.

“Short subdivision” is the division of land into four or less lots, tracts, parcels, sites, or divisions for the purpose of sale or lease and shall include resubdivision of previously platted land, and shall include properties divided for purposes of sale of townhouse units. 16.08.170 Street.

“Street” is a public right-of-way which is intended to provide or which provides a roadway for vehicular circulation or principal means of access to abutting properties and which may also include provisions for public utilities, pedestrian walkways, and drainage. (Ord. 67 § 4(4.10), 1972)

16.08.180 Subdivider.

“Subdivider” is a person, firm or corporation that undertakes to create a subdivision. (Ord. 67 § 4(4.18), 1972)

16.08.190 Subdivision.

“Subdivision” is the division of lands into five or more lots, tracts, parcels, sites, or divisions for the purpose of sale or lease and shall include all resubdivision of previously platted land, and shall include properties divided for purposes of sale of townhouse units. (Ord. 67 § 4(4.01), 1972)

16.08.200 Utilities.

“Utilities” includes water, sewers, drainage and gas lines, overhead and underground electric, telephone and cable TV facilities. (Ord. 67 § 4(4.19), 1972)
