2.24.010 Created – Judge – Appointment.

A. Authority. Pursuant to Chapter 3.50 RCW, there is created and established an inferior court to be known and designated as a municipal court, entitled “The Municipal Court of the City of Pacific,” which court shall have exclusive original criminal jurisdiction of all other actions brought to enforce or recover license penalties or forfeitures declared or given by such city ordinances or by any state statutes. The municipal court shall have jurisdiction and shall exercise all power granted to it under the Revised Code of Washington, together with such other powers and jurisdictions as are generally conferred in this state by either common law or by express statute upon the municipal court.

B. Judge. The municipal court judge shall be appointed by the mayor, and confirmed by a majority vote of the city council. The person appointed as municipal judge shall be a citizen of the United States and the state. The position of such municipal judge shall be on a part-time basis.

C. Judge’s Appointment. Such appointment shall be for a term of four years. Appointment shall be made in a like manner by the fifteenth day of December preceding the end of every such four-year term. 2.24.020 Judge’s salary.

The salary of the municipal court judge shall be fixed by ordinance of the city council from time to time; RCW 3.50.080. (Ord. 1929 § 2, 2016; Ord. 334 § 2, 1961).

2.24.030 Deposit of moneys collected.

All fees, costs, fines, forfeitures and other moneys imposed or collected by the municipal court for the violation of any municipal ordinance, together with any other revenues received by the municipal court, shall be deposited with the finance director as a part of the general fund of the city; RCW 3.50.100. 2.24.040 Pleadings, practice and procedure.

Pleadings, practice and procedure in cases not governed by statutes or rules specifically applicable to municipal courts shall, insofar as applicable, be governed by the statutes and rules now existing including the applicable provisions of RCW Title 3 or as may hereafter be adopted governing the pleadings, practice and procedure applicable to district courts; RCW 3.50.450. 2.24.050 Judge pro tem – Position established.

There is established a position to be known as judge pro tem, which judge pro tem shall act in the absence of the regular municipal judge of the city and shall have all of the powers and duties of the regular municipal judge; RCW 3.02.060. (Ord. 1929 § 5, 2016; Ord. 516 § 1, 1972).

2.24.060 Judge pro tem – Appointment – Qualifications.

The presiding judge is hereby directed to appoint necessary judges pro tem to act in the absence or disability of the duly qualified municipal judge. The judges pro tem shall be qualified to hold the position of judge of the municipal court as provided for in PMC 2.24.010; RCW 3.50.090. 2.24.065 Court administrator.

There shall be a court administrator of the municipal court appointed and removed by the municipal judge. The municipal court judge shall supervise and control the court administrator. The court administrator shall perform such duties as may be prescribed by law for a court administrator or a court clerk and shall perform such other duties as may be assigned by the municipal court judge. The court administrator shall be paid such compensation as the city council may provide from time to time; RCW 3.50.080. (Ord. 1929 § 7, 2016; Ord. 1604 § 1, 2005; Ord. 1219 § 1, 1994).

2.24.070 Court clerk.

There shall be a court clerk of the municipal court appointed and removed by the municipal court judge. The court clerk shall be supervised by the court administrator and shall perform such duties as may be assigned by the municipal court judge or the court administrator. The court clerk shall be paid such compensation as the city council may provide from time to time; RCW 3.50.080. (Ord. 1929 § 8, 2016; Ord. 1219 § 2, 1994; Ord. 664 § 1, 1977).

2.24.080 Costs.

Repealed by Ord. 1929. (Ord. 910 § 1, 1983).
