9.55.010 Fireworks defined.

As used in this chapter, the term “fireworks” means all fireworks, special fireworks, common fireworks and pyrotechnics, as defined in Chapter 70.77 RCW. (Ord. 774 § 1, 2021)

9.55.020 Discharge of fireworks unlawful – Exceptions.

It is unlawful for any person to use, discharge, ignite or explode any fireworks within the town of Twisp, except during the following times and dates:

December 31st, beginning at 3:00 p.m. and ending on January 1st at 11:00 p.m. (Ord. 774 § 1, 2021)

9.55.030 Authority of mayor to suspend, shorten or ban the use or discharge of fireworks.

The mayor of the town of Twisp is authorized to suspend, shorten or ban the use or discharge of fireworks at times and dates provided in TMC 9.55.020 for any purpose deemed necessary or to protect the health and safety of the public, upon at least 14 days’ prior notice to the public by posting such order on the town’s website and posting such order at the Town Hall, and at least three other conspicuous places within the town. 9.55.040 Penalties for violation.

Any person violating or failing to comply with the provisions of this chapter, which does not also constitute a violation of state law, shall be guilty of a civil infraction, and upon conviction thereof, shall be imposed a civil penalty up to $250.00 for each offense. Any violation of this chapter, which also constitutes a violation of state law, shall be punishable under state law penalties. In addition, any fireworks that are involved in the violation may be confiscated. (Ord. 774 § 1, 2021)
